    that statement is a load of %obblers , and proves who the IAS work for , the machine was faulty , simple as that , it did not return the excess when it issued the ticket ,

    Yep, the driver did pay the right tariff, the fault was with the machine for not registering one coin.

    Im just writing the Defence section for my claim form, i have pasted what i have so far. Any advice/changes appreciated. I dont pretend to know this process or any legal language i may need to be writing in.

    I also visited the car park on Saturday, the charges are still the same as they were in Jan 2015 £2.40 0-2 hours and £3.60 2-4 hours. I took a photo of the sign, it says No Change Given (Overpayment Accepted). Any comments on this?

    I wish to dispute all of this claim.

    I received a PCN on 15/01/2015 to which i replied by email on 18/01/2015 explaining the situation.

    In relation to a letter I received with the above reference on, I appeal this notice.

    I put £3.60 in the machine in order to buy a ticket for a 4 hour period, as you can see from my ticket (enclosed), the machine only registered £3.50 therefore I can only think that 10p was left in the machine. The machine did not tell me this, that my 10p was not registered and therefore I believed I was buying a ticket for 4 hours. As I'm sure you will agree I would not have deliberately put £3.50 in the machine should I only have wanted to buy a ticket for 2 hours which cost £2.40.

    I will happily send a cheque for the 10p (which was left in the machine) or post a 10p through the post. I would be grateful if you would cancel this Parking Charge and inform me by email when this is done.

    I received a letter back from Excel Parking on 04.02.2015 acknowledging my email.
    I appealed to the Independent Appeals Service on 06.02.2015.

    I attempted to rectify the situation immediately, offering to send the 10p in the post. £60 charge for 10p is extortionate. The ticket machine took my money and gave me a ticket for the shorter time. It did not refund me Obviously my last 10p didnt register, either the machine was faulty or the coin didnt register, however i didnt hear the coin drop.

    UNFORTUNATELY you are dealing with three idiots here

    IAS
    BWLEGAL

    Your job is to make them look idiots in court, that's if they don't discontinue this utter rubbish. A judge does not expect you to be a legal begal or use legal jargon, the judge will consider the evidence given.
    Let the judge question the claimant. It is very difficult to understand how BWLegal will substantiate the claim and it will probably end up with their known incompetence being shown yet again

    I doubt that BWLegal even know or understand what the problem is, BWLegal seem to take on any old case from Excel without question.
    That is probably why judges raise their eyebrows when BWLegal are in court and why BWLegal are classed as being incompetent

    In writing your defence you should understand that a judge is just as human as you, there are some however that should be put out to grass, its a bit of a lottery.

    So, an attention grabber
    *I DID PAY THE FULL AMOUNT OF £3.60
    *THE MACHINE ONLY ACCEPTED £3.50 AND PRINTED A TICKET FOR 2 HOURS
    * I DID NOT OVERPAY FOR 2 HRS, I PAID FOR 3 HOURS
    * THE MACHINE IS CLEARLY FAULTY
    * WOULD I OVERPAY BY 90p TO AVOID 10p ?
    * EXCEL IGNORED MY APPEAL BUT NEVER OFFERED TO REFUND
    THE OVERPAYMENT OF 90p AND THEN ATTEMPTED TO CHARGE ME £100
    * I THEREFORE ASK THE COURT TO DISMISS THIS CASE AS THIS IS WASTING THE COURTS TIME FOR THE SAKE OF 10p

    Read up on "unreasonable hehaviour, CPR27.14(2)(g) and prepare to give the a good kicking.

    you paid £3-60 and were issued with a receipt albeit for £3-50,
    its like buying a sandwich in Tesco's then being stopped on exit and a security guard insisting you owe £100 because there is an error on the receipt
