    Hello,

    Rec'd a letter today from BW Legal saying their client intends to continue with the claim. And they have filed notice of our client's intention to proceed with the court.

    Also rec'd a Notice of Proposed Allocation to the Small Claims Track, that this is now a defended claim and that i must complete the questionnaire by 6th Feb.

    I will complete the questionnaire, any advice please or message of support!????!!! Hate the thought of having to go to court, but i will to defend £264.96 which they are saying is the balance due when it was 10p!

    When you win, ask the judge for CPR27.14(2)(g) unreasonable behaviour cost.

  • they are saying that you only paid £3.50 , and the parking was £3.60 , therefore their lose is 10p

    the fact that they

    a: have not asked you for the missing 10p

    b: have escalated costs out of all proportion

    will look very very funny to a judge

    get it on paper , mediation , you are (and have always been) offering to cover the shortfall , they are refusing to accept this .and continue to be stupid and extracting the ^&$s out of the county court system

    Remember in my earlier post, I said

    "The machine itself has a problem allowing it to print a ticket for 2 hrs at a price of £3.50.

    I think you can prove that in all good faith that you paid the full amount of £3.60. Nobody would put in £3.50 and try to avoid 10p

    Machines I have used will not print a ticket until the correct amount
    is paid. I would imagine the same happens to a judge.

    This means that BWLegal are taking you to court for a 10 pence error so what happened to the 90p that was overpaid for a 2 hr ticket."


    BWLegal have very serious mental problems if they really believe a court will accept their rubbish ..... and it is rubbish, the county court system is not for claiming an underpayment of 10p only to falsely inflating it to £264.96

    BWLegal make payday loans look credible.
    This where BWLegal completely ignore the principals of the SRA
    This in turn makes the SRA look like complete idiots.

    As far as mediation is concerned, these people are a few steps behind judges. In other words they don't have a clue.
    The same as the CAB ...... WORTHLESS

    Do remember that you want to know what happened to the 90P OVERPAY ....... excel have that money.
