Driver denying liability accident on roundabout

Looked but can't see anything - but apologies if already posted somewhere else.

40 mph dual carriage way with roundabout leading to Supermarket.

Traffic uses both lanes to go straight ahead

To get to the Supermarket you need to be in right hand lane. Approaching from 6 O'clock coming off at 3 O'clock.

The other driver was in the left hand lane and came straight across our front with the resulting accident.

A couple of seconds earlier it would have been a full on side impact

We are both with the same insurance company, so they are going to have to pay out.

Our car has 000's of damage the other party hardly a scratch.

The other driver has admitted being in the left hand lane, but is denying liability.

Any suggestions on what can be done to ensure we are not jointly blamed.

We've so far provided images of the road layout from Google & Pictures of the damage to both cars

    It's not for the other driver to admit liability (if you read up in your policy you will see it is a condition not to admit liability)


    Make sure the insurer knows your side of the story. If you have any independent witnesses that will help

    Where is he come from? Did he come from 9'oclock? Did you check your mirror before exiting the round about?

    I'm confused about the OP's description too. Just because you want to take an exit, doesn't mean it is safe to do so.

    OP, provide a Google Maps (or alternative) link of the roundabout and describe accurately the path you took round it, the path the other car took, and the point of collision.

    To me it reads the 3rd party cut or straight lined the roundabout and collided with OP.

    Sounds to me like there are 2 lanes on the roundabout and left is for left turn (9 o'clock) and straight ahead (12) and right is for straight ahead or right (3 o'clock) - they were starting from 6 o'clock

    The car was in left lane and OP has tried to go straight ahead while other car has tried to go right at the roundabout (270 degree "turn") from the left hand lane and collided.

    Assuming the left hand lane is marked as left/straight ahead it should be fairly open and shut.

    Edit - you'll need to go on street view to see this properly, I thought the google maps links would stay on street view but it seems to default to the map view if you click on the link but works if you open in a new tab

    To illustrate the point with an example similar, there is a cinema/restaurant park near me where cars routinely take the left lane of 2 at the filter lights (where the white car is, next to the highway maintenance truck) when crossing the main road to try and nip ahead of traffic in the right

    They then try and cut in right as they assume everyone is going into the supermarket lane but often get stuck by traffic also going straight on

    They then get to the roundabout stuck in the left lane (if they haven't raced off at the lights to get ahead) and try and swing all the way around to the right nearly colliding with traffic in the right hand lane

    It should be open and shut even if there are no markings. The HC is clear that the RH lane should be used for the RH exit.

    We both came from 6 O'clock. There are only two exits off the roundabout 12 & 3.


    3 being for the supermarket, which is where the other driver was going

    I would have to agree. From the description given, OP was going straight. It is therefore the responsibility of the person in the left hand lane to check it was clear before changing lanes to go right.

    OP - as you are both with the same insurer, the company may look to settle 50/50, given it would increase both premiums. Push for 100/0 given you appear not to be in the wrong here.
