    Judge didn't want to go into all the rest of the case because he'd already picked up on the fact that they couldn't and hadn't identified the driver.


    Did he say anything about Elliott v Loake and AJH Films?


    I'll let parking prankster know, he may message you for a bit more detail (eg what judge said about EvL and AJH)

    They mentioned Elliot and Loake... I didn't even get chance to say anything about it but Judge didn't really make any comment.
    No mention of AJH films at all. Disappointed as I went armed with everything!! That's how I feel... disappointed really. Happy that I won obviously but disappointed that I didn't get chance to argue to various points

    Well done you. Despite your disappointment in not being able to grind them into the dirt, a win is a win - and they've LOST yet another case!

    Sorry you got a bit bruised, but a win is a win when you do litigation, so well done.
    the point missed here by the DJ was that as the PoC were so brief and they had not complied with the pre-action obligations, you had no information and documents to go by, so you had to do a "catch all" defence addressing and incorporated every argument

    As LoC123 says, you had an unfortunate choice between going all in with your statement or applying to court and risking your hard-earned to kick out their dodgy particulars of claim. The court should have been sympathetic that you had to pre-empt whatever argument arose.

    The overheads aren't massive, but even on fixed fees, the PPC is £100 down, possibly £145. The irony of those numbers not being lost on anyone here....
