Just been reading back thru your thread for the 1st time. You've had some fabulous help along the way. Trust me you will be fine, i think LoC said, your S.A. should do most of your talking for you. And if they are relying on CPS v AJH Films & El v Loake they are clearly clutching at straws. That's good early start, go get em....good luck. cm620

Calm....
You need to take copies of YOUR documents, not theirs (bit late now but hopefully you will have realised that).
If you are prepared for RoA argument, find out who your oppo is, ask them their name and qualificiations. If a solicitor ask them what firm they are employed in/a partner in, if a barrister ask what chambers they are part of [answer in both cases likely to be none, in which case no RoA] - if you just get the name, there is a BMPA telephone number you can ring to find out if they have RoA.
That's not to say that the judge will be interested in the argument. Many people don't run it at all, or start to run it then give up when the judge doesn't show much interest, or because the oppo starts claiming they have RoA and the LiP doesn't understand enough about the whole thing to argue against them.
Your q about the contract that they've now produced - this is a COSTS argument now. They should have produced it long ago under the Pre-Action Practice Direction para 6(a) and (c) and it's costs issue if they haven't.Although a practising Solicitor, my posts here are NOT legal advice, but are personal opinion based on limited facts provided anonymously by forum users. I accept no liability for the accuracy of any such posts and users are advised that, if they wish to obtain formal legal advice specific to their case, they must seek instruct and pay a solicitor.0 -
I don't know what my question is was about Costs now. Just parked. Walking to court. First job is to try and find out who's There for the C then. I've got the bmpa number to text.0
