    I don't know what my question is was about Costs now. Just parked. Walking to court. First job is to try and find out who's There for the C then. I've got the bmpa number to text.

    Well I won guys. Only awarded £21 Costs which I am disappointed in as that doesn't even cover all the printing and ink. But I know it cost them to bring this so its cost them more. Thank you everyone for your help. I'm going to need a stiff drink and I'm going away for a few days but ill write something up when my headache has gone!

    That they haven't proved who was driving.
    DJ said byelaws were irrelevent as private land. Didn't even get chance to argue it. He said my witness statement was irrelevant and unfocused... bit harsh... we put a lot of work into that LOL but just hope it puts them off doing this to someone else.

  • I agree that parts of the WS were irrelevant and unfocussed - the point missed here by the DJ was that as the PoC were so brief and they had not complied with the pre-action obligations, you had no information and documents to go by, so you had to do a "catch all" defence addressing and incorporated every argument because you had no idea how they were making out their claim. That point was made at the start of your WS.
