    make sure you let the BPA have copies of those too (everything , unredacted)

    apcoa have messed up there and may just drop it

    besides which , byelaws apply so after 6 months the airport cannot enforce the issue anyway (under the byelaws) , so the longer the saga goes on , the better for you

    2. POPLA and appeal process for Railway Land
    There is a meeting on 27th January 2017 to discuss this issues. John Gallagher decided to
    make a decision on the outstanding cases as they could not stay adjourned, he concluded
    that he would allow them all. He has invited the Operators to withdraw them and will allow
    the rest. He is meeting with with the DVLA, DCLG and the Railway Operators on the 27
    January 2017 to agree the process including the appeals.
    If you park in a railway car park it will be a criminal case and they will allow clamping, which
    does not seem good practice.
    One possibility is the DVLA to say that operators can continue to use POPLA but this means all
    appeals will be dismissed. Currently they are bound by the decision where the appellant is
    not. The alternative will be to take POPLA out of the equation and then it is pursued through
    the criminal system


    for some reason (I can guess it) they are only refering to railways , not airports / docks etc


    I suspect the reason will become clearer very soon

    i wrote an email to bpa but they said they cant involve in the matter as they aren't sure that the post was sent or the post was received by me unless it was recorded delivery.
    i called apcoa to discuss and they said they refused the appeal and sent me the letter with popla code but i did not received anything and the 28 days period has passed. now i don't know what to do.
    please help.

    in an earlier post you said "yes i have got the automated reply from the apcoa. and the email i sent to them." and yet the BPA are saying " as they aren't sure that the post was sent or the post was received by me unless it was recorded delivery."

    get back on to them and say your appeal was by wmail with a follow up letter (belt + braces) and enclose the automated reply state that no POPLa code was recieved by email or mail , but yet scum and co say they sent one


    go to http://www.parkingcowboys.co.uk/popla-code-checker/ and come back with the date it was issued


    in recent weeks , with the ISPA statement and the POPLa worries apcoa seem to bec reluctant to issue codes (about 10 cases in last 7-10 days )

    they know at POPLa they will loose and it will cost them £27 , if they can get out of POPLa , they can carry on with the DR+ crap


    in fact turn it around with the BPA , they stipulate recorded delivery , can apcoa prove that they sent the code by recorded delivery after you submitted claim by both POP AND email to which you had an automated reply


    whats good for you (recorded) is good for them ,,,

    The BPA are saying it's tough APCOA's supposed letter went astray (they would say that).

    Just ignore APCOA now is my advice. They are mucking you around, forget it then.

    They do not sue people and I believe their contracts are basic with no right to do so (based on a past case chucked out when they tried, once, 2 or 3 years ago).

  • CM , getting out of giving a POPLa code , or giving false ones (2018) <pepipoo> is there way of not paying £27 or getting fobbed off by POPLa , what happens in those cases , if a test case rules in favour at airports in the next 6 yrs?

    needs sorting NOW , BPA are aware whats happening , but are wearing blinkers

    Yes but the BPA refuse to act, we've tried it before, they expect consumers to be able to prove appealing but not their members to prove rejecting. No point doing anything, it is only APCOA.

    The OP would do better to write to her MP and Marcus Jones of the DCLG. Ask them if they think 'self-regulation' by this industry is working.
