Pcn from apcoa at Luton Airport

Hi

Driver was droping the airport staff on the early morning around 6:30, it was a bit foggy and dark. couldn't see the no parking sign and the customer said she can get off here because the traffic was moving very slowly. And now After 18 days received the pcn from apcoa for the alleged contravention of failing to park/stop in a designated area.

On the letter it says the driver of the vehicle at the time of breach of terms and conditions detailed above is required to pay the parking charges in respect of the above and these have not yet been paid in full.
It says if the driver want to appeal They need to put Name, address, VRM and the pcn in the appeal and need to do it within 28 days.

I have seen couple of treads regarding the same issue, so I was thinking to do the same as some of the members have done previously.

Please advise me if I can do anything about it.

I will be very thankful for your help and advice.

    yes , its not relevant land and its not a car park , doesnt stop APCOA from trying to fool people , even though its a road where byelaws apply

    send the blue text BPA letter from the NEWBIES sticky thread , as KEEPER , do not name the driver or imply who was driving (edit post #1 so no details are revealed too) - only mention what the driver did , never use the words (me , myself or I)

    if the KEEPER gets a popla code , use similar appeals to recent 2016 appeals , especially citing POFA2012 etc

    POPLA have these on hold at the moment as its a murky area , but you still have to follow the same procedures as all the others you read

    ie:- go through the motions

    As long as the driver is not identified these are very easy to beat at POPLA!

    I will go through the previous threads but as you said I don't have to mention who was driving but can write my name as the registered keeper or not???
    And can I take one of the previous appeal and put my details or form one myself??? because I am not very good at it but I can give it a try to form a letter.

    Use the 'in blue writing' appeal template in the NEWBIES thread, that's what it's there for (DO NOT COPY IT HERE PLEASE). You won't be posting a letter anyway, not snail mail.

    use the KEEPER template (blue text) you were told to use, it will likely be refused by APCOA so expect it , this is done by the person they wrote to , as KEEPER

    they should issue a POPLA code with the rejection

    this is when you use the info on here to draft a popla appeal, there are enough to choose from so easy to copy and paste

    you still have not done what I said and edited your first post , changing the details to (the driver did this , the driver did that , the passenger/customer told THE DRIVER)

    do not help APCOA by writing a witeness statement , use the typical reply of NO COMMENT

    now edit post #1 and then appeal with the blue text template, you wont be composing any "letters"

    go to post #1 , click EDIT and advanced edit and edit it , simple as that

    its a blue roundel/oval , bottom left of post #1 , only you can do it so it only shows up on your posts

    yes , thats fine , easy wasnt it ? :)

    now send the blue text appeal to apcoa , then prepare the popla appeal from a recent similar case and await the popla code
