If you do not have the self control to ignore your phone whilst driving switch it off or put it in the boot. When driving a car your only focus is driving the car and making adequate observations of what is happening around you.
I often speak to people about their accidents and despite saying they are not driving it often becomes apparent they are at which point I terminate the call. Unfortunately in one occasion what identified he was driving was when his passenger started screaming because he had hit an animal in the road.0 -

Get a proper car kit installed if you must take calls while driving. The fact you had it on passenger seat sounds like you have it ready to take calls/read texts if need be while driving.0

Funnily enough, yes. I am far from whiter than white in many ways, but I won't use my mobile while driving. That's because when I am behind the wheel I am driving the car, not socialising, getting shopping lists, arranging meetings, and so on. As far as I am concerned, if you are caught once you should be banned for a year. Second time, for life. This is very weird coming from the "voice of the govt and corporate interests" that is the BBC, they posted something about phone use recently on Facebook too. Before this practically every road incident they reported on would having "speeding" carefully crafted into the news story.
I'm waiting to see where this leads, I wonder if it's precursor to bending public opinion in favour of increased CCTV surveillance or something. In much the same way they gave us story after story demonising the internet, before Cameron and his pals started censoring it.“I may not agree with you, but I will defend to the death your right to make an a** of yourself.”

The phone was on the passenger seat. To me, that implies he/she was expecting to be using the phone during the journey. Otherwise, it could have been switched off or in the boot, no?
