They have up to 35 days to respond with a decision. Use that time to start boning up on how to draft a successful POPLA appeal - it will pay dividends for you.
Read NEWBIES FAQ sticky, post #4 and the last few pages of the POPLA Decisions sticky. You'll be able to blitz this when the time comes.Please note, we are not a legal advice forum. The blue appeal, in my opinion, is perfect for those who have, in some way, "contravened" the T&C. I does, however, mark you out as a forum aided appellant. No bad thing.
But in a case where you haven't contravened, as you imply, and have proof of being on the premises, then I believe that this should be your primary appeal point, avoiding admitting to be the driver. So I would add this to my appeal, enclosing a copy of the receipt.
However, you need to tread carefully on this as, if the receipt shows, say, a purchase at 10.00 a.m. and the ticket is timed at 11.55 and the signs give you 60 or even 90 minutes free parking, then there is an admission of contravention by the driver.
So - the receipt could either be a strong plank in your defence or a self-inflicted wound and that is why I am 100% with post #4 about the signage being vital if the PPC eventually complies with POFA.
So, what is the time limit for free parking?0 -
When you send your e-mail to appeals@herefordshirecspm.org don't forget to select the "Request Delivery Receipt" and "Request Read Receipt" options.
The good news is that Corporate Services' Notices to Keeper make no mention of using POFA to hold the vehicle's keeper liable. Even the weakest of the POPLA assessors should be able to spot the NTK's non-compliance and when the time comes, this should be top of the list of points in your submission to POPLA.0 -

Well the company have been back in touch to say the signage was corr CT and we are in breath and they have provided a POPLA code!
We didn't enclose the receipt from KFC (as Guys Dad very kindly advised!) as we weren't sure if we outstayed the parking time although we were on the premises eating, chatting etc.
So what now ............write a POPLA appeal ........... finding this all a bit stressful! Had a lot of il health in the family and a lot of hospital visits ......I must admit .we are thinking of paying the reduced amount!!
Ps no we haven't spoken to KFC.......
Any further advice to help ease the pain would be greatly appreciated!

Oh I forgot to say my partner did go in and complain to the manager at the time and he was very apologetic and said that the car park was run by a private citizen any but hat there was no time limit attached to the parking as long as you are using the venue.
The food was bought at 1.39pm and the ticket was issued at 15.58. It was raining outside and friends joined us during our visit so we were there longer than we usually are but WE WERE THERE!!!

I am at the popla stage of the appeal for our PCN (my partners!) and on reading your post I think I may have made a mistake! On the original reply to the PCN company I used the template email as suggested by people on here which didnt mention anything about the food receipt we have as I did as was asked and didnt 'reinvent the wheel'
I know you guys who have greater knowledge of this process find it all very straightforward but I don't. If I had written my own letter I feel I would have submitted my food receipt and now I have asked for a little bit of help and there have been no replies .......is there any help out there??
Where to go from here? We are feeling nervous and have until 26th Dec to pay .............or lose the lesser amount to pay!0 -
Sending in receipts to prove being a customer only works with certain PPCs - I don't ever recall Corporate Services being one of those. Small fry operators rarely cancel anything; they're desperate for your money. So no damage done on your part.
