    If the ticket and all other paperwork such as NTK etc only cites "not on premises" then your POPLA appeal must major on that. That means sending a copy of the receipt to POPLA. If you also have a credit card statement that shows the purchase as well that would be even more helpful.

    The PPC has almost certainly lost any chance to add overstaying even if it happened if it is not on the reason for charge.

    You must also demand a witness statement from the operative who drew up the ticket explaining just how they determined that the driver was not on premises. Did operative enter both ladies and gents toilets? You don't admit who was driving. The driver did visit the toilet during their stay and might have been in the loo at the time.

    Proof of receipt does not prove that driver was on the premises so stating that they were conducting business and also on the Web will need to be added. Any corroboration from the KFC circle of clients you mention will be most useful too.

    Thank you for your response. For some reason I couldn't see any responses earlier!!!

    Anyway I have submitted my appeal to POPLA enclosing all evidence ie PCN notice saying the car owner was not on the premises, copy of the bill, photographs of all signage which says for patrons only etc etc

    Fingers crossed the appeal s successful!

    Hi peoples. Need some advice for some friends. They both got a failure to pay notice from Herefordshirecpsm for failing to display. However no notice or ticket was placed on the car. They knew nothing until the failure to.pay letter. This put them beyond the DOPLA appeal date. Appeals by email to the email address stated on the letter was returned as non-deliverable... this was two cars at least on the same night with no note on the car... is this legal? How can they progress an appeal when out of time and company email doesn't work? Grateful for advice please
