PCN from Corporate Services, parking management, Hereford

Hello

I am new here but have read several threads re parking fines!

My partner went into KFC and bought a late lunch just before 2pm on a weekday last week and parked his car in the car park. He ate his lunch, used the bathroom and did some business in the KFC ring of clients etc. Whe he got back out to his car there was a PCN notice on the windscreen which says -Contravention- not using the venue at the time of parking!

He went straight back in and spoke with a member of staff who said they could not help him as the car park was owned by a private company!

This is ridiculous! He has a copy of his till receipt and it does show he was in the KFC for about two hours!!

Can anyone help us ....we are not sure how to respond or appeal to this notice but obviously need to do it fairly soon as the fee goes up to £100 from £60 after a certain period of time!

    It matters not about the charge increasing - you/he aren't going to pay it anyway are you??

    Well I thought it was a fine?! Not sure what you mean here, I have read the newbies thread but as the company is a member of one of the registered organisations i am a little confused.

    I have read that I should wait and not pay within the 14 days then use the template but I Di t feel the template is relevant as I am not interested in the signage!!

    Perhaps you could clarify please!!

    Yes you are. If they are claiming breach of a contract, the contract is written on the sign.

    Check the ticket again, as they may claim an overstay instead at the next stage - which they can do.

    Not a fine (which you get for breaking the law).

    You have a bill for supposedly breaking a contract!

    You say you have been sent this by a member of a register??

    Your decision on appealing will be based on whether or not you can get a popla code.

    Read the faq thread and decide whether or not you are dealing with a bpa company and take it from there

    Read the Sticky thread for NEWBIES then send the relevant template (we don't know which one because you haven't told us the name of the parking company) as near to the appeal deadline as possible.
    Don't edit it, don't reveal who was driving, don't appeal to soon, don't ignore it, don't miss the appeal deadline.

    Follow the advice in the NEWBIES. Read it several times until you understand how to beat this unregulated scam industry. There is a lot to take in but you have time to read it and understand how it all works.

    The advice you have been given is the best you will get anywhere, and it's free. Don't ignore the advice even if you don't understand it. It is there because it works, so don't try to re-invent the wheel.

    Both templates are relevant, but only to the relevant ATA, and signage is extremely important so please don't dismiss it.

    The statement that it is not a fine is quite simple. You will not find that word used anywhere on the windscreen ticket as it is only a speculative invoice.

    The name of the company is Corporate Services (Parking Management) Hereford company.

    So the date on the bill is 11th November so I am to wait 26 days then send the letter, and as the company is a member of the BPA I should send the appropriate letter!

    It's all a bit overwhelming and we are thinking is it worth all the bother of possibly being taken to court etc or just pay them £60 and be done with it!!

    Dilemma!!

    Not a dilemma at all. Don't do it please! Read this that we post all the time when people are wavering and think paying is the easiest way out:

    You want to beat them or join them? Do you want to fund the next few PCNs against vulnerable people?

    Or pay nothing and not fund this bunch?

    Then appeal as keeper around day 26 if it can be done online/email (a week or so earlier if they ONLY Offer postal appeals). This is fairly simple to beat at POPLA as long as the PCN shows they are a BPA AOS member and offer 'POPLA' (on the back in the blurb). A POPLA win by a keeper (NOT driver) kills it.

    How is it overwhelming to copy and paste that blue letter and stick it in the post/email it?


    You are a long long way off any court action over this, and will get help here over your POPLA appeal (assuming you need to make one)

    Just 'copy & paste' the appeal already written for you (everyone with a BPA member PCN) on day 26 if the PCN offers electronic appeal.

    So simple it's astonishing that people waver. So nasty to even think of funding a protection racket.

    You have a receipt from the KFC at the time the invoice was issued, so their "not a customer" claim won't wash. They have almost no chance of a successful court claim over a "leaving site" case. The last company to try that, VCS, was threatened with contempt of court when they tried.
