  • A lot of the times the buyer is actually the owner of the credit card, but as the chances of them getting prosecuted for this is minimal, they can only gain by claiming it was a misused card.
    The chances of anyone being bothered to tie the credit card to the address you sent to is minimal, and even then, theres no possibility of disproving the fact the item may not have arrived, it was there mate who done it etc etc.

    Give up on the automated stuff... persist in reaching a real person, paypal staff aren't too bad on the phone actually. If it feels like you're headed for an automated dead end, pick a different option until you get a person.

    It's the credit card company calling the shots... where they lead, paypal is legally obliged to follow. Paypal don't like it any more than you that their transaction has been reversed.

    As above, it is possible to have seller protection without a confirmed address. This thread may be of interest to those interested in the technicalities. The pink bannered posts are from a paypal rep. I don't think it will help OP though... unless by some fluke it DOES say they were eligible for seller protection on their transaction.

    2) Is a transaction that involves an UNconfirmed address, but in all other ways qualifies for 'Seller Protection' coverage, as per the User Agreement, still covered for 'Seller Protection' in the event of a 'chargeback' based on an 'an unauthorised payment'? Yes

    Yep, I agree. I can picture them sitting there smiling, with my camera and the money too.
    I think I really need to press this as a criminal case and get the focus off
    the paypal t&c etc.
    I bet the buyer's credit card co. hasn't even pursued it to the police,
    preferring to target the soft option...the seller.

    I'll have to try and find out.
    nb... it was signed delivery, but not sure that will help locate the recipient.

    Have had a look through all of the buyer's ebay feedback and there is a pattern.
    The ebay account was opened in 2002. Up until Feb 2007, there were a lot of clothes sales by the account holder.
    After Feb 2007 there are no more sales, only purchases!
    and now electronic goods -phones and cameras.
    Between feb and july this year, there are no transactions at all.
    from july 24 until end august only purchases of electronic goods, 90%
    mobile phones.
    Two or three of these feedbacks report the account as hacked and by end of august the account was closed. The original account holder must have lost a few thousand!
    Unfortunately, my sale was at the front end of this hack...27 July.
