UKPC Parking Charge - November 2016.

So guys, it's now the time for my appeal... just re-reading the NEEWBIE thread though and I'm a bit unsure on which appeal template to send? The one beginning:Re PCN number:
I am not ignoring your charge for a purported parking infraction. As the driver has not been identified, I require the following information so that I can make an informed decision:
 1. Who is the party that contracted with your company? I require their contact details and the full identity of the landowner.
 2. Is your charge based on damages for breach of contract? Answer yes or no.
 3. If the charge is based on damages for breach of contract please provide your justification of this sum.
Seems more apt in this case, "leaving the site," than the one in blue:Date
 Dear Sirs
 Re: PCN No. ....................
I challenge this 'PCN' as keeper of the car and I will complain to the landowner about the matter if it is not cancelled.
I believe that your signs fail the test of 'large lettering' and prominence, as established in ParkingEye Ltd v Beavis. Your unremarkable and obscure signs were not seen by the driver, are in very small print and the terms are not readable to drivers.
Tomorrow is the 26th day :money:0

No, it is the BPA one in blue. But you could mix the two, no worries.
As long as you only choose registered keeper on the drop-down menu on UKPC's website. Look at their photos of the signs while you are there (usually blurred and useful for illustrating your POPLA appeal later.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thanks for that! Proof of sale (scanned) was also tagged onto the appeal, hopefully save a bit of time in me having to respond...0
-
Not had any correspondence back yet after the appeal was started, other than the auto reply.
This line in the reply intrigued me a bit:Your charge will be placed on hold whilst under appeal and we will aim to respond to you by formal letter/e-mail to the address supplied within 35 days, should you not receive a response within this time, please contact our information line on 0333 220 1070.
What happens if after the 35 days is up? Is it void anyway then? I'm ringing no one 0 0
-
35 days is a bit fluid. Missing that deadline will not invalidate your ticket. It will be 'complain time' to the BPA if you get no response at all - but most PPCs respond around about the 35 day point.

They'll send you the usual waste-of-time letter first, asking for 'more information'. Ignore that and come back at POPLA stage after Christmas, where you can build a POPLA appeal using the templates in post #3 of the NEWBIES thread.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Okay, so I got the "standard" please send proof that you used the facilities email/.pdf response today... I'd actually already sent them the proof (1x store receipt/1x credit receipt) with the initial appeal but they obviously ignored it - rather than do it though the online way, isn't there a direct appeals email address that's often mentioned on here? I can't seem to find it right now.
Thanks people, it feels I'm a bit nearer to the end of all this 0 0

Actually, comparing to other's replies, this one looks slightly different?Thank you for your recent correspondence in relation to the above Parking Charge.
In order to make a final decision regarding your appeal, please can you provide evidence of using the facilities on
site to our Appeals Department within 14 days of the date of this letter.
All of our signage is fully compliant with the guidelines set out within the BPA Code of Practice and we reject the
notion that it is in any way unclear or ambiguous.
The contract that UKPC has with the owner or occupier of the land (which authorises UKPC to enter into a contract
with the driver requiring the payment of Parking Charges in respect of parking of the vehicle on the land) contains a
confidentiality clause and as such we are not in a position to provide the contract to you.
As a member of the Approved Operator Scheme, UKPC are audited by the British Parking Association to ensure
that we have all relevant contracts in place. UKPC will provide the court with a copy of this in full if they require it, or
can provide a written statement to this effect from those party to the contract. We are also more than happy to
provide confirmation to the independent assessors that we are authorised to manage parking at this site.
We can confirm that parking management at this site has been contracted to UK Parking Control Ltd.
Paragraph 9(2)(b) of schedule 4 of the Protection of Freedoms Act 2012, states that we must inform the registered
keeper that the driver of a vehicle is required to pay the parking charge in full. It also notes that as we do not know
the driver’s name or current postal address, the registered keeper, if they were not the driver at the time, should
inform the operator (i.e. us) of the name and current address of the driver and pass the notice to them.
The Act also warns that if, at the end of the period of 28 days (beginning with the day after the Parking Charge is
sent), the parking charge has not been paid in full and the operator does not know both the name and current
address of the driver, the operator has the right to recover any unpaid part of the parking charge from the
registered keeper. This warning is given under Paragraph 9(2)(f) of Schedule 4 of the Protection of Freedoms Act
2012 and is subject to us complying with the applicable conditions under Schedule 4 of that Act (which we consider
we do comply with, to the letter).
Failure to provide this information will give us no alternative other than to make our final decision based on the
previous information received, at this stage a POPLA verification code will be provided.
Further correspondence can be sent to our postal address below or on our website at https://www.ukpcappeals.co.uk.
Please can you ensure that your parking charge details are attached when sending further correspondence.
The Parking Charge has been on hold whilst under appeal and may be settled in full at the reduced rate of £60.
PLEASE DO NOT IGNORE THIS LETTER. UKPC REGULARLY TAKES MOTORISTS TO COURT WHO IGNORE
THEIR PARKING CHARGES. PLEASE SEE: https://www.ukparkingcontrol.com/parking-legalities FOR FURTHER
 INFORMATION.
Still worth replying to it with a scan of said receipts to, I found the address, appealmoreinfo@ukparkingcontrol.com?0

Why not? They've asked for them, there's no 'trap' that I can foresee (unless you inadvertently identify the driver, so stay schtum on that point). It might just flush UKPC out as to where any 'spend' threshold might be.
Send copies only (redacted if you're sending bank/cc syaements). Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

            Thanks!
Have said:Please see attached, "evidence of using the facilities" as requested.
 Regards.
 Didn't even sign it off...
Spend threshold? You think they even go there?! I can't imagine for one second they even have any direct dealings with the onsite stores/restaurants, do they?0
