Bensons for Beds useless warranty & FIRA

Hello
We bough a divan set from Bensons for Beds 2 years ago. The mattress has sunken in the middle which makes sleeping on it uncomfortable. As the mattress is still under the 5 year warranty, Bensons for Beds sent out an "independent" assessor from FIRA to assess. His report has come back saying there is no fault!
It is clear from the pictures I initially sent to Bensons for Beds that there is a defect-. I contacted Bensons for Beds who have told me that they must go by what the FIRA report states and that is the end of the matter!
Is there anything I can do to take this further? A mattress should not fail in 2 years. I paid by credit card. Thanks

Settlement simply means that you have layed on it and left your mark. Just like you get squashed bits of carpet under the feet of your sofa, or a bum print on your dining chairs, you get a body print on your mattress. Whether it has foam or a layer of fibres etc, it is inevitable. And technically not a fault.
HOWEVER
It shouldn't make the mattress uncomfortable and if it is more than just the fibres settling, you would be able to make the case that it's faulty. But the technician doesn't seem to agree. I haven't seen it so I can't express an opinion.
There are ways to prevent settling such as flipping and/or rotating the mattress every few months. Or using a mattress topper.Hi. Thanks for your reply. We have turned and rotated it on a regular basis. I have referred this to the Furniture Ombudsman so we shall see what happens next.0

Hi Mcduff
Seems your not the only one who has had problems with FIRA.
I have a faulty mattress from Bensons for beds who sent a "independent" technican out.
Basically the technician told us the mattress had collapsed and that it was a full foam mattress. When I received the report it said the complete opposite and that no fault was found. The technician was from the unreliable FIRA.
Emails have gone back and forth because after he left, I found my mattress's spec sheet and it actually states it has 1050 springs more then technician reported.
There reply was miscommunication and that he'd stated it was spring he just wasn't sure how many. A complete and utter lie nothing on those lines was spoken.
We know one thing no one should trust FIRA because if the technician can't report a fault correctly then they can't repair one correctly either and this is what the company is all about.
I wondered if I paid for the report would it read in my favour....... answer most diffenatly.
I haven't forwarded my problem on to the furniture ombudsman what I've done is been as I paid with my Visa I contacted my Banks Disputes team who are confident with all the information I've forwarded to them that I wil get my money back.
How did your problem end up ??????0
