    Just thought I would add this which I found on the Direct.gov website;for child benefit

    a young person under 19 (under 20 in some cases) who is either studying in full-time further education (A level or equivalent) or on an approved training programme

    Also on the same site for EMA it does state that the learning needs to take place in England.

    If your over 19 you should be able to get Adult Learning Grant it is almost the same thing as EMA but we dont get the bonus :-(.
    Is your course 23 guided hrs learning per week? If so that is high for further ed, mine is 16 per week. Could you drop one subject to lower the amount of hrs your in college? This situation really does suck and i feel so sorry for you, I do hope that something can be worked out.

    Hi Nad 1611,

    I phoned Child Benefit and Child Tax Credits yesterday just to check and once again got told that HND is classed as advanced education. So therefore not entitled. Maybe someone else can let us know if HND is advanced education. Obviously we've both been told different things :confused:

    Adult learning grant is only available to anyone who doesnt have a A-level where i do.

    I have found a clause in EMA and am trying to get it via this clause.

    i will have to pick another pack up to post the clause but it means i may be able to get EMA with the help of connexions and them wirting a Flexable Learning Certificate.

    not much of a help I know but if you and your sister are both classed as students (and non-one else lives in the property) then you will be able to get an exemption for the full council tax.

    well i found out more today.

    ema maybe wait to hear from them. college will be part time ish, so can claim low income with council to help me with rent and c tax. just need to find myself a job now.

    I am just wondering if anyone knows what i can do. i though i could stay at college till 21 and them im of to uni i just missed out this year so i have to do another and i have gained sponsorship as well.


    You have mentioned sponsorship and when I double checked everything again today was told that if you were being paid anything to do the course this may affect your right to certain benefits.


    I have confirmed today that you can receive child tax credit and child benefit for your child if they are in full time education and on a Btec National diploma until the child is 20 on their birthday payments will stop. Also you can get ema until your 20th birthday too. Hope this helps.

    you can get EMA till 21 with the help of conections doing a flexable learning certificat.

    At the moment im not geting sponsorship but when im at uni i will so everythings ok when i get to uni.

    but i think everything may be sorted now. just need to find a job really and bring it some money to cover income suport that i was on.


    A BIG THANX TO EVERYONE WHO HAS POSTED AND TRIED TO HELP.

    If anyone else has any problems like this i would recoment citezens advice as they helped me so much and were amazing i think as they knew everything.

    Not necessarily, you can take a break of 13 weeks due to the Child Benefit extension period.

    The tax credit people are very good at bending this rule
