Request for popla refused despite quoting legislation, what to do now?

    That's great, Gin and Milk you have got your mojo back! That looks to cover the bases you need to cover.
    Nothing from Gladstones. I'm guessing that they have an 11th hour tactic.
    Indeed they don't seem to do anything much on any cases until the victim moves first, then they often file their own WS late.

    If they miss the deadline, write a quick final gasp letter to the court in your husband's name, pointing out the unfairness and that Gladstones are attempting to re-plead the case within a very late Witness Statement, having not bothered until this point to provide sufficient particulars. Gladstones being on record as admitting it is not worth their while to provide particulars because (paraphrasing!) the majority of hounded victims give up.

  • Phew! Thanks for taking a look at it and fingers crossed it will suffice. I'm going to hand deliver the bundle to the court today and post Gladstones 1st class with proof of postage.
    I'm half hoping they do submit theirs late, I need the time to spend on my assignment as much as anything. If I don't receive it by Tuesday I'll take a letter to the court.
    It would be great if they didn't turn up, but having had a quick look, I get the impression they attend far more than they miss if you know what I mean.
    I'm just glad I've done it!

    Hi G&M, I'm more a serial observer of this forum than a regular contributor, but just wanted to wish you good luck for this one and keep that fighting hat on!

    And I know this isn't for everyone but personally, if I was at court stage, I'd rather they did turn up so that I could hopefully see them get a spanking by the judge!

    Just had a text from hubby to say the DVLA have been in touch. MB contacted the for details on 24th August snd the DVLA released them on the 25th. Thing is the NTK is dated the 25th August so I find it a bit strange that they sent the NTK on the same day that they received the info from the DVLA. Don't think I kept the envelope with the date stamp and off the top of my head I don't know if they've contacted the DVLA earlier than they should. Which would be a bit annoying really!

    All done electronically - so everything is pretty much instant, and robotic - little or no human intervention, they don't even need an envelope licker.

    I'd read nothing into the speed at which this was carried out.
