Request for popla refused despite quoting legislation, what to do now?

  • Out of sheer curiosity I decided to google the judge's name and got quite a pleasant surprise.
    On an entirely different forum, someone who must have had problems with a credit card was taken to court. They didn't have any evidence to present and when the solicitor pointed this out, he said it was a bit rich coming from them given the lousy quality and scarcity of their evidence. The defendant won!

    It's given me a bit of hope. Fingers crossed he'll be on our side and that he hates PPCs and Gladstones as much as we all do!

  • Well Gladstones should have received their WS from me today. Technically speaking yesterday afternoon would have been the official 14 day cut off point.

    However, I've had nothing from them this morning which I'm not massively surprised about.

    My question is, do I write a quick letter to the judge and hand deliver it tomorrow regardless of whether or not the WS arrives tomorrow? The court paper doesn't say anything about the 14 day deadline including (or not including) weekends and bank holidays, so I'm guessing it's 14 days regardless? I can't get to the court to hand deliver it today, tomorrow morning is the soonest I can do it.

    I hand delivered everything to the court on Friday, much to my relief!

  • Well I've just sat down to write a letter to the court about Gladstones WS and it seems that I have miscalculated my dates! The Notice of Allocation states that documents must be delivered no later than 14 days before the hearing.
    The hearing is the 31st, so counting backwards from that, the 14 day deadline is actually tomorrow isn't it?

    Yes that is right - you have done your bit and it is very possible G's will be late anyway....have that letter ready to deliver in less than 48 hours.

  • Does it have to be hand-delivered to the court? Not emailed? That would save time.
  • I'm not sure tbh. I just had it in mind that I'd hand deliver it as I had with the WS. Fingers crossed nothing arrived today!
  • Yes, since the court is local, it makes sense to hand deliver. Is there a time limit? 4pm as with the Northampton court? I suppose an expert will be along here shortly to advise you. Best wishes anyway.
  • There's no mention of a time limit on any of the documents I received so I'm guessing the answer is no. My husband is going to text me to let me know whether or not anythimg arrives today. The postman usually comes around 10ish so fingers crossed they won't deliver. If it's an attempt to replead I'm hoping the judge will think that's a waste of time and money and call the whole thing off. I do seem to be hoping for a lot of things though!
  • Right, I've just had a message from my husband to say nothing has arrived from Gladstones, so they have missed the deadline.
    My question is, do I print off the letter and hand deliver it to the court today, or am I better off waiting until tomorrow?
    I'm guessing that it would be OK to deliver it today and that I should mention that the post has already been but nothing was received from Gladstones?

    I'm just after a bit of reassurance really as it would be difficult to get to the court tomorrow and they have definitely missed the deadline.
