Do I have a case or shall I just pay it? Galdstone letter

Options
Hi,

This is my second post. 3 months after sending my initial letter to SiP I have received a letter from Sip informing me that my appeal is not with in the time frame of PCN and they don't accept my appeal.
I have now received a LBC from Gladstenos (misspelled on purpose). I been trying to read all the information on this forum but there is so much stuff and its all very confusing and hard to understand.
Part of me thinks I should just give in and pay. But even their payment method (by phone only) scares me as I don't want to give my bank details to some random company.
Please help - I really don't know what to do. I'm now scared this will affect my credit score as well. :(

    I forgot to add.
Pay by the Phone app was used (use it ever day at work) but for some reason the payment on that day hasnt gone through. When realized (as no conformation email sent) - payed for the whole day parking again straight away. Unfortunately this was over 40min after already got the ticket.
I appreciate any help and advice - thanks

Do not, unless so ordered by a Judge, pay them a penny, it is a scam. With a little bit of effort, YOU can cost THEM money.

Gladstones are being investigated by the SRA for several alleged malpractices as they have received hundreds of complaints.

If Gladstones are asking for more than £100, have mentioned Beavis, Elliot v Loake, or have threatened you with a CCJ, report them to Duncan Allen at

Thanks, so if I understand this correctly this won't affect my credit score (as its not court order).
So I just write back a acknowledge letter as per other threads here ( for example - Gladstones / PCM Court Defence thread).
They've asked me to confirm the driver - do i have to do this?

Clearly you have not read the stickies. Please make sure that you understand the rules before entering the field of play.

Do not under any circumstances reveal who was driving.
I married my cousin. I had to...
    I don't have a sister. :D
    All my screwdrivers are cordless.

Do not confirm the driver - you are not required to, and it only makes your case weaker.

This also cannot affect your credit score unless it goes to court, you lose, and then don't pay up.
  • I've read the stickies, and I have not reveled anything to them. Wasn't sure if this is the same rules applied as this is no longer SiP request but solicitors now. Like I said before I find this very stressful. Thank you for your advice thou

Gladstones is a solicitor in name only, they really don't know what they are doing or (apparently) how the laws affecting private parking work. Assume everything they say to you is either wrong or misleading, because it is.

The worst case scenario would be if you lost at a court hearing, but even then a registered keeper can only be liable for the PCN sum plus court fees & interest (so, about £175 all told). That's IF you lost a defended case! Still no CCJ happens, if you then paid as directed by a Judge.

Compare that to the letters from Gladstones which try to add extra costs and often at this stage, are demanding over £200. Anyone would be mad to pay at this stage just to make it go away, when it can be fought and won. You certainly have a case.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • Are you saying the 'observed' and 'time of issue' were left blank by the scammer?
Not sure what you mean by that sorry...
