Went to Council this morning, gave all the evidence Drs letter (which confirmed my depression and that I was having difficulty coping with my financial situation) and they say that they won't take an apllication for Homelessness from me as it would be found that I had made myself intentionally homesless, that would then mean that I was put to the bottom of the Housing Register!

This is totally incredible, mot. Are they saying that they can not take an application from you TODAY but may take an application on Monday?

Whoever you spoke with, at the council, was an arrogant jobsworth who has obviously forgotten that he/she is a public servant whose wages are, in part, paid for out of the council tax that you have been paying for years.

Unfortunately local councils would appear to be overflowing with this type of employee.

Did you speak with CAB? Something is bang out of order here.

Got another appt with Council on Thurs at 10.30 to register as Homeless. Going to CAB tomorrow.

They say I made myself 'intentionally homeless' because I couldn't pay my rent for 7 months. I was existing on small amount of maintenance, CTC, Child Benefit, WTC (although thats stopping as got claim in for IB taking ages to reach decision) and small amount of HB - all this was used to survive ie: bills, food, petrol, childrens school trips, uniform, shoes and clothes (they're tall and in adult sizes - so no gain from buying kids stuff anymore and no hand me downs from anyone as they're taller than all their friends). Council didn't like fact that I had had to use HB to exist even though I have been asking since beginning of year if they could help anymore as I couldn't afford to live and pay rent. In the end I just couldn't cope and something had to give. Its not as if the twins have new clothes and shoes readily only when absolutely necessary, DS has gone from a size 6 shoe earlier this year to a size 9:eek: - now you'll all think I'm breeding Hagrids:rotfl: sorry, had to try and make myself laugh!

Forgat to say that the girl at the Council told me that the Drs note wasn't enough to prove my depression and inability to cope financially - I would have to see a psychiatrist to prove that I was unable to manage my finaces due to depression

Where will it all end  ?

I have always been an organised person who has dealt with whatever life has thrown at me and has never been afraid to ask for advice, but what we've been through in the last 3 years or so has taken its toll and the advice from outside MSE has been unbelieveably contradictary - just don't what or who to believe or turn to anymore.

Awww hunny, you are not a failure. Re-read this thread from the start and imagine that you were looking in from the outside and you were reading about someone elses life. Do you really think that you are a failure??

I just think that the ***** hit the fan and unfortunately it's your fan this time round. Everyone is here to support you :)

I'm sure that if at least half the people on this thread (including myself) could, we would've gone to your council and given them what for! (Don't even get me started on your LL chucking your stuff out of the shed ).

We're all here for you, even though that may not feel like much at the moment :)

    Why????
As you said yourself the reason why you couldnt pay the rent was because you had to CLOTHE your children, you are not a failure hun, not at all, you are a decent mum who is trying to bring her kids up. I believe everything happens for a reason hun
My story with housing - had to privately rent for a year after ds was born, as we both worked and were considered by the council as "financially viable" to find accommodation ourselves, which makes me really angry as had i been a drug addict or jobless they would have given me something.
4 years ago, private rent round here was 400pcm, found a cheaper place down the road so moved in, he wanted 300pcm. 3 weeks later found out it was council owned and he was illegally sub-letting to me. council said initially that i was making myself intentionally homeless, then found me a house 5 days later!!!
They use that phrase as a scare tactic hun, see what they say on thursday chick xxxx

Thanks all you - I'm sorry to keep offloading on you all but your replies do help me.

The rent here was £900pcm when I moved (3 bed semi, no garden) I was working so could afford it. Then after the first 6months the LL put the rent up to £1000pcm because I was using the garage to store 14 flattened packing boxes, 3 garden hand tools, a carpet cleaner in a box and 2 flat garden chairs! He said he would clear it out for me to be able to put my car in - guess what? - he didn't, and then proceeded to fill it even more so I couldn't get to my stuff. None of that matters now its just to give you an idea of what he's like, and don't get me started on the maintenance of the property that he hasn't done    .

Anyway, thats history - need to get out and get settled, just so bl**dy hard

The only failure is that pr*t that interviewed you at the Council. He/she has failed dismally in his/her obligations to treat you, and your children, with courtesy and respect.

  • Just wanted to say stay strong to you. You are obviously doing your best in a very tough situation. How anyone can claim you made yourself intentionally homeless is beyond me. Feeding, clothing and caring for your children does not make you a failure- you did what you needed to to survive and noone should be blamed for that. Just keep fighting - I haven't anything more practical but it sounds like you are doing all the right things. All the best.

    Hi

Have you spoken to your ward councillor. They may be able to contact the houssing lot for you.

Also, I think you should get a free half hour with a solcitor or get CAB to help and send a warning missive across your landlord's bows. The Council will be assuming that he will keep to the law, and I doubt if he know what his responsibilites are, or the limits to his rights.
If you've have not made a mistake, you've made nothing
