Found a Law Service site last night on the CLS website recommended to me by Penguin83, going to call them later and see if I can set up an appointment to see them.
I-T and I doing a strong but politely worded letter to Council today confirming EVERYTHING that has happened ie: LL informing me on the night I picked keys up that he was selling and the unsettlement to the twins and I that that caused etc - if you or anyone can think of anything I can include to make my case even stronger I'd be really grateful :TChristians Against Poverty - www.capuk.org0 -
I'm still shocked that they're like this with you - as I said we were put onto our local homeless team when our LL started being a tosswad - but we told them hopefully our housing will be sorted, and we'd rather see the place go to someone who genuinely needed it. The team were really helpful, and it goes to show how different some councils are.
I would put everything in writing - how often you've seen them, the phonecalls, the time spent int heir offices and the effects on your family. Include a copy of the doctors note, and all the relevant documents. Ask them to reconsider the case as a matter of urgency.
I would ask them that seeing as they're being so unhelpful, what can they suggest in place, as paperwork is all well and good, but you need a roof over your head!
Don't forget to send it recorded, more money but then they can't claim no-one received it, or hand deliver and ask the reception to sign for it.
Good luck love, if I was closer I'd offer our spare room, you shouldn't have to go through this. Be strong, the kids need you. Camp out at the council offices if need be!! Have they told you if there's any other avenues you can exlore?This year I'm getting organised once and for all, and going to buy a house with my wonderful other half. And that' s final!

Have a look at this site, it is form another council, but the rules will be the same, it gives you the criteria that you need to fulfill to be classed as homeless. It might be worthwhile going though this one by one and writing down how your situation fits this criteria. I would then take this with you to your appt on Thursday when you present yourself as homeless, then at least you will have the basic answers to their questions.

I have just read through your thread. Gosh these p*****ks in housing department make me mad! If your IB had been paid promptly then you wouldn't have had to use the housing benefit to feed and clothe your children. I really hope that they sort you out tomorrow. Is there someone who can come with you for moral support? That way they can't brow beat you into doing something against your own best interest.
Plus I am sure that the bit about needing a psychiatrist to confirm your inability to cope with your finances is so much dohickey to be polite. That is basically calling into question the professional competance of your GP!

I don't have any practical advice, other than to stya strong, as u seem to be doing so well....
With regards to the LL situation, perhaps u could post something on the LL and tenancy board, and see if u get any suggestions - I've never used that board, but I'm sure there are some friendlies there too!

That is a great link, vandanfc - I have read the policy and it would appear that mot's council are clearly not following the guidelines/rules.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

hi you say that you was only getting a small amount of hb the hb is worked out on what the law says you need to live on when my other half was off work sick we got full hb because we got less than the 197 per week the law says you have to live on
so was your income more than 197 per week once you paid your rent basicaly anything over 197 is put towards your rent for example if you was reciving 220 per week but your rent was 130 per week your hb claim should of been around 107 per week leaving you the 197 the laws says you need to live on (i know the amount the law says you need to live on changes depending on the size of your famley our is two adults and two kids)
if this is not the case your hb team may of made a mistake i would find out what the law says you need to live on this should be on your hb letter if not go back to the hb team and get them to find out for youi cant slow down i wont be waiting for you i cant stop now because im dancing0 -
sorry forgot to put that if you took on the tenncy for more than hb would pay for example hb would pay around 7 to 8 hundred for a three bed then hosing benefit wouldnt cover the extra 1 2 hundred pound a month over the hb claim and if that is the case then they will say that you made your self in this position as you knew you couldnt aford the rent and you could of found cheeper accommindationi cant slow down i wont be waiting for you i cant stop now because im dancing0
