    Thanks BartGirl, I have just given myself a 'talking to' and realised that as LL has sold/is selling property we will be homeless anyway, and with no money to be able to pay for privately rented again then maybe there is 'hope' :confused:

    Thanks pania, although its getting increasingly hard to stay strong. Each time an email pops up in the corner of monitor I hold ny breath until I see who its from.

    Dear Miss ****,

    Re: Housing Act 1996 Part VII (as amended by the Homelessness Act 2002)


    I am writing about your application for housing assistance as a homeless person. I must inform you that it appears on the evidence before us that your homelessness may have been caused intentionally.

    This is because you have lost your last settled accommodation as a result of rent arrears. From information already provided and investigation carried out it would appear that your accommodation was affordable and that you had sufficient income to maintain regular payments. You were in receipt of Housing Benefit, which was £***.**every fortnight, and though you had a shortfall this was affordable. You have confirmed that you used this money for other things instead. There were no severe medical issues that would prevent you from managing your affairs. From your own statements and having dealt with you for the past month, I can confirm that you do manage all other affairs well without any help or support from any agency. You do not have problems paying any other bills and have managed to maintain a three-bedroom accommodation as well as care for your two children.

    However, I am writing to ask you if there is anything further you feel the Council should take into account before making a final decision. Please detail everything, even if you think it is not relevant. You may also wish to provide other supporting evidence.

    If the decision is made that you are intentionally homeless, the Council will only provide you with temporary accommodation for a short time to give you a chance of finding your own accommodation. After that time you will have to leave the temporary accommodation and no further housing will be provided to you by the Council under this Act.

    In order that a final decision can be made quickly an appointment has been made for you with the Senior Homelessness Officer and myself on 26th October at 10.30AM to discuss your decision. Should you fail to attend this appointment we will have no alternative but to come to a decision on this matter on the evidence already before us.

    So did they actually BOTHER TO READ your Drs letter? Doesn't sound like it! I really hope that you can take someone with you tomorrow to give you moral support.

    I really don't know what to say. Well I do but it would be bleeped out by the swear filters.

    So if you'd starved the kids to pay your rent, Social would have tried to bury you but the council would have rehoused you?

    Can you get your MP or some kind of legal rep to accompany you to the meeting?

    Ok, mumoftwins, have a ((())) to be going on with. Deep breath. Cup of tea, and something sweet to eat.

    You still have an appointment.

    This letter doesn't say anything at all about the fact that you are being evicted because the landlord has sold the house. I would have thought this was the main reason you cannot go on living in the same house, regardless of the rent arrears.

    Lots of your other supporters will be along soon to give you more knowledgeable help than I can but I shall be sending very positive thoughts your way!!

    I can't believe they haven't accepted your Dr's letter as an indication of your health when things started to go pear-shaped. Contact your Doctor and ask for their help again, to support you & argue against the "severe medical issues".

    Ring Cllr doodah, and get her to accompany you tomorrow - she's your Councillor, so quite entitled to have her in attendance. If nothing else, it will put the cat amongst the pigeons that the Portfolio Holder is involved.

    Also, make a list of points you want to question like "what about the house being sold & the eviction", "What rent-bond schemes do you have in place?" (look on their website....)

    I'm so sorry the decision hasn't gone your way, although I'm not altogether surprised.
    Ok first of all does the appointment time suit you? Will you have enough time to gather all your additional supporting info? If not change it, don't be railroaded into this appointment unless you have everything you need. Is this interview part of your review/appeal process or something separate?
    Can you get more supporting evidence re: your mental health issues to show that you couldn't handle your finances due to your depression?

    I can, most Dr's letters aren't great tbh. They're usually a paragraph at most and say things like 'ms x feels like she can't cope' or 'mr x would like a bungalow' rather than stating their own opinion. The medical advisor will be more interested in what treatment MOT was getting eg medication, counselling, hospital addimission and whether a psychiatrist was involved etc because this will give a better indication to the severity of her condition.
