    Hi, I'm wondering how you got on love, let us know. We got served with an eviction notive a few months back - we made the landlord sort of the horrendous black mould problem, so he served a section 21 at the end of our tenancy, then told us if we paid more money, he wouldn't enforce it!!

    We got the council involved, they came to an agreement witht he property managenent company he brought in at the very end, but luckily we're in the process of buying a home - but I do know how you feel when you get that piece of paper - eviction is something that happenes to drug dealers or ASBO queens, not decent people. Our council sent someone to see us, but we told them we could stay with friends, as I felt too bad to be taking a home up when we will (hopefully) be sorted.

    I really hope all goes well, they must be sympathetic when you have kiddies, plus the fact that you were up front with your loandlord will have helped.

    Is anything happeneing re the dismissal from work?
    This year I'm getting organised once and for all, and going to buy a house with my wonderful other half. And that' s final!

    Hope it all went fairly smoothly today I didn't get a chance to post yesterday but have been thinking of you.

    We've been in your situation. When my son was a few months old we came back from a weekend in Scotland at my Granma's funeral at midnight after driving 8 hours to find our locks changed and us unable to get into our flat. We rang my in laws (one of the most embarrasing moments ever) as we knew they had only just got home as well. They put us up on their floor. The next day we rang the HA and they said we could get in a few days to remove all our stuff. We said that we wouldn't be able to arrange anything so quickly and they threatened to remove our stuff. We went to the council but they deemed us intentionally homeless and having some where to live. So we went to the CAB and they went into bat for us. They explained to the council that because of my mental health and an injury I could not work and was having problems that led to this happening. They arranged for the council to pay for the removal and storage of our goods and for us to pay them back in small amounts. They also made the council house us, after in laws wrote a letter saying that we couldn't stay there. We had to stay in B&B for 8 months and then were given a flat.

    Please don't panic too much and come back and ask for any help you need from the folks here, they will give you a lot of good advice.

    Morning all,

    Thank you so for your messages of support - it really helped me.

    When I arrived at court I had a long conversation with the Duty Solicitor who works on behalf of Shelter. He came in with me and spoke on my behalf. The Judge had read my statement (which I had only handed in when I arrived) and although he has confirmed the Possession Order he seemed very fair. I wasn't disputing having to leave (LL has sold property) and so it was over and done with quickly. Judge 'awarded' judgement and I just wait to hear how they expect me to pay outstanding rent back! Have made a small offer per month but we'll see.

    It wasn't nearly as frightening as I thought, in fact LL's solicitor seemed more nervous than me - he had made a couple of errors and the Judge commented on that adn LL's Sol was shaking - quite funny really!

    Anyway, Shelter Sol has said that i MUST get a solicitor to help me with regard to my homelessness application to the Council as they will do anything to try and prevent me from getting a home - by this he means stalling and us going into B&B, or saying that I have made us intenetionally homeless!

    As we have to be out of here by 1st October he has advised me to find a solicitor locally who specialises in negotiating with the local auth, he couldn't see me until 4th October!!! So I spent yesterday afternoon ringing around locally and even ringing the LAw Society but as yet I haven't found a solicitor - Oh yes and they need to be to offering Legal Aid as I will qualify for that.

    Although the date for eviction is 1st October apparently if the Council haven't offered me anywhere before then the LL's sol will have to apply to the court for a Bailiff's warrant which will be sent to me so that I know when they coming. Once I have received this I then have to take it to the Council and my solicitor.

    I rang the Homesless Dept at the council y'day pm but the woman I needed to speak to wasn't in so I have to ring back this morning. Then I will have to make an appt to go and fill in Homesless App form and take all sorts of info with - one of which will a Drs letter as I thought this may help proving how depressed I have been over all this.

    So in a nutshell today I have to:

    Ring Council
    Find a Solicitor (think I will go and queue at CAB this morning and ask their advice)
    Make appt for Drs
    Write a letter to LL's sol re access to the garage (showed him a photo of the garage at court y'day - its stuffed full of LL's things and I can;t get to my 6 items or so plus I have a lot of flatten packing boxes in there which I need to start packing :mad: - LL's sol was gobsmacked and LL just stood ther and said 'I will help you (me) move the stuff' to which I replied 'no ***** I can't help you I have a bad back and enough to do - they are your items please remove!)

    Sorry for the rambling post but thats my mind at the mo!

    CAB should have a list of local solicitors and which ones do what.

    Have you got an appointment with Shelter? They would be best help if there is one in your area, CAB would often refer people to Shelter. If there's not someone near you though CAB is a good option for making sure you know what to do, some CAB have a Housing specialist who you should make an appointment with. Doctor's letter is very important as council should take note of reasons like that.
