That was very brave of you putting that report up on here MOT.

My only slight concern is that given the glowing references surrounding I-T in the report, and the fact his place is too small, he is too poor to take you in etc. etc. the Council may see your housing application as a 'ruse' - i.e. you're trying to get a council house and, when you do, will then promptly move I-T in. Be aware that that question may come up and you need to have answers prepared and ready.

I think it is a very fair report. To my mind it clearly shows you did not make yourself intentionally homeless. All the bits in red apply:11.17.
Generally, an act or omission should not be considered deliberate where:
i) the act or omission was non-payment of rent which was the result of housing
benefit delays, or financial difficulties which were beyond the applicant’s control;
ii) the housing authority has reason to believe the applicant is incapable of managing
his or her affairs, for example, by reason of age, mental illness or disability;
iii) the act or omission was the result of limited mental capacity; or a temporary
aberration or aberrations caused by mental illness, frailty, or an assessed substance
abuse problem;
iv) the act or omission was made when the applicant was under duress;
v) imprudence or lack of foresight on the part of an applicant led to homelessness
but the act or omission was in good faith

The report makes a big point of saying that your priority is your children, so I can't see that the council could acuse you of it being a ruse. After all, if they give you a home big enough for your children, it makes no difference to them if I-T eventually moves in or not. I think it looks like a brilliant report, not waffly, and straight to the point that you did not deliberately make yourself homeless. Also not condemning of you saying just that you can't cope but still saying well dressed, IT is lovely, kids are good and happy etc. All in all very positive I think.
Incidentally your earlier post about your 'weird ways' they sound a bit OCD to me which must surely make your situation more intolerable.
I think you sound a lovely person with lovely kids and a lovely man and when this horrid situation is over you will still have all these positives. Your life can only improve, I have a friend who is clinically depressed because she lost her husband and if she gets better she still is alone but with you your 'happy life' is still there its just getting squashed by the crap. I agree 2008 will be your year!! Much love and the most sincerely I have ever wished Happy New Year! Viv0 -

mot : i think the report is going to be extreemly usefull in your battle its fair and to the point and what with other evidence i cant see how they can dismiss it or ignore the points raised.
and just remember without your stregnth and determination it wouldn't of happened.

If the above is the case, then maybe you ought to query I-T being referred to as your "partner". That does seem to imply that you don't want separate homes and I was a bit concerned that it might affect your case myself. It doesn't look to me as if the LA would turn a hair at implying that you were on the fiddle - they seem to have thrown everything else at you! :mad: :mad: Don't give the cynical, opportunistic Bs a toehold!

Hi mot - haven't posted much lately, but I wanted you to know that I am still very actively following your thread.
I agree, wholeheartedly, with basketcase - you should not allow I-T to be referred to as your 'partner' as this could, in the wrong hands, be interpreted in his 'having obligations' to your current situation.
I-T's support has been, is and will be, invaluable in your case, but there certainly appears to be those who may read more into your relationship than that.
Hope the preparations for Christmas are going okay.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
