    MOT,

    APPEAL the refusal of the Crisis Loan. It might take a few days or even a week but APPEAL. As for the storage words fail me:eek: BUT!!!!!!!!!!! WHEN you win this case against the council you must and I stress this MUST have "YOUR SOLICITOR"(I love that phrase) Bill the Housing Dept for all the storage costs. If they had done there job properly in the first place you wouldnt have incurred these costs.
    Have you had the written refusal for the Crisis Loan yet? as soon as you do fire off the appeal letter. Include Everything and for added emphasis include the name and tel number of your support worker and your "Solicitor"(theres that phrase again!!):T
    I know you are so fed up of fighting and fighting to get what you need but do not let this go MOT you need this money.
    I agree that the rent seems a bit steep maybe get your support worker to check your benefits I dont think you are receiving your full allowance. Have you applied for the DLA yet?

    MOT..so sorry for what you are going through...this government beggars belief..I cannot believe what is happening to you and your family and there must be a lot more people going through this as well..people that we don't hear about..I do hope you can get this sorted they are utterly heartless ...this government is never interested in good honest hardworking tax payers only in the likes of drug addicts and alcy types....I can only send you and yours hugs and hope that your solicitor, mp and paper can shame them into taking responsibility for what they should've already..good luck xx

    Unfortunately there is nothing in the housing act states an authority has to pay for storage charges, only that they have to ensure belongings are not at risk, and they are allowed to charge a reasonable fee for that.

    MOT appeal against the decision to refuse youa loan, a person who is homeless is entitled to claim a community care grant to cover moving costs, so it is worth going down both routes especially as you do not have to re pay a community care grant.

    I understand that the Housing Authority do not have to pay storage costs. Its just that MOT would not have incurred these costs if they had dealt with her application fairly in the first instance. I just think it might be worth pursuing the costs aspect WHEN she wins.:T

    If mot knows anybody who the authority has housed in interim or temporary acc either under a s188 or a full s193 duty then she would have a good argument. It is worth asking the authority to see their written policy on this matter as some authorities have a policy that states they only pay for people on i.s and every body else is considered ona case by case basis and it is means tested.

    It does seem that every thing is going against mot at the moment, it is not fair that she has to fight so hard every step of the way.

    Borgie, if I felt my ex would help out I would but as his parting words to my Mum when we split were that he had 'never wanted the twins in the first place' I doubt he would help - particularly as it involves me - he could never see that his fascination with hard !!!!!! hurt and disgusted me in a way that I don't how I will ever recover and that is why I divorced him.

    I did ask the HA what they did to help with storage and they offered me an insecure garage for £8.00 per week and I would possibly have needed 2, but I couldn't take the risk of it being broken into and my furniture stolen, also these garages weren't watertight!

    Mumoftwins - Hi, I hope that you are ok, and I hope that some of this helps:
    Have you had the appeal yet on the hless decision, I take it that you were fuond to be unintentionally hless but in priority need. From having looked at this myself, I would reiterate the fact that intentional hlesssness is when an applicant has made a deliberate act or omission which has resulted in their hlesness. Rent arrears alone, is not neccesarily a deliberate act.

    Your rent arrears which resulted in the eviction accrued as a result of a relationship breakdown. At the point of moving into the property, it was an affordable rent and you were in employment. At the point of service of notice, you had found yourself out of work - not intentionally and as a result were unable to maintain your rental payments, this was not a deliberate act or ommission but was an unintentional act due to unintentional loss of employment.

    Excuse me for being daft, but I see it as simple as that. Hless depts and legal services like to blind us all with science, and 'could you manage you affairs' etc, but the crroks of the matte is that you DID NOT intentionally not pay the rent and that had you of remained in employment you would have maintained the rent payments and would not have become hless.
