    That is nonsense, and I suspect you know it.

    The point is that the car is accessible by at least one member of the public, and is therefore subject to the smoking prohibition.

    So by that logic every where is a public place.

    Within the meaning of this particular piece of legislation, possibly..

    But that is totally irrelevant since the legislation only applies to certain defined places, e.g. vehicles.

    So that's your private car by your interpretation of the legislation.

    I'm a member of the public, and I definitely remember having access to a hire vehicle at least seven or eight times this year alone.



    You don't have access to someone else's hire car, that's my point
