    No but the person hiring it is A MEMBER of the public. Perhaps I missed the bit in the law where it said there has to be lots of them at once. Then the next day - let me guess who hires it ... Anyone ?

    That is nonsense, and I suspect you know it.

    The point is that the car is accessible by at least one member of the public, and is therefore subject to the smoking prohibition.

    So by that logic every where is a public place.

    Within the meaning of this particular piece of legislation, possibly..

    But that is totally irrelevant since the legislation only applies to certain defined places, e.g. vehicles.

    And with one person within doesn't make it accessible to the public.
