    i cancelled yesterday, just told them i dont want it anymore.
    i have knocked up my own vehcile check sheet that i am going to try and get the collection driver to sign to state that the car is in the same condition as it was given to me.
    i am also going to be recording the entire handback process with my phone. i have also got 2 work colleagues who are going to witness the check and sign back and i will get get statements off of them just in case.
    i am probably going overboard but i want to cover myself in case they try anything.

    car is being collected today.

  • ok. the vehicle has been collected.
    guy turned up in a car transporter.
    he checked it over, found no problems.
    i then asked him again and he said it is all fine.
    i then produced my form for him to sign. which he happily did.
    the main bit i got him to sign was: " I __________________ certify that the vehicle has been returned in the same condition it was delivered. There is no further damage and therefore no reason to claim for damages at a later date."
    i got my name and signature, his name & signature, and witness name and signature.
    i just gotta sit back and see what they throw at me now.

    just 30 seconds after putting my last reply i got an email from them with a PDF attached regarding the collection inspection.
    it states no further damgage!

    i'd like to think that is the end of it but it can't see it.

    so from this stage forward. are they likely to still come up with some fabricated damage?

    will they try and sting me a cancellation fee?

    or will they even try and charge me for the 1 day i had the car despite the 3rd party claimed responsibilty and drive assist should be claiming any hire charge from the 3rd party insurers?

    lets see what happens

    I think you will be ok.

    The problems with DA finding damage are allegedly because the delivery driver is paid low wages and has to deliver the car in a very short time scale. This means they often do a very quick check of the car and miss existing damage. However the driver who collects the car funnily enough is given plenty of time to check for damage so they find the damage that the delivery driver did not note down which results in them asking for money to cover the "damage".

    Allegedly they also give the collection drivers a very small amount of money for fuel, so if it's a long drive when they get back to the yard the fuel gauge is lower than when it was delivered.

    As you have got your form filled out and the car was collected on a transporter, I think you should be ok.

    Minster Law solicitors and Drive Assist are partner businesses. They do the warm transfer of telephone calls form their call centres to Drive Assist calls centres as soon as they find the accidents are no fault of yours.
    Minster Law is an outsourced type claim processing business, and many brokers and underwriters employ them.
    If It is a third party fault, it is always better to do the claim via the third party insurer's company and avoid all together these claims b*stardising companies like Minster La, Drive assist, Legal claims etc. Of course you can have repairs at your choice of garage too.

    I have only done 20 miles in it and it is still on half full which is what the report says when it was dropped off, should I put some petrol in it?


    Will the costs be from Tuesday late afternoon when I got it too today when I cancelled or until Monday when they pick it up.

    Does the contract you signed say that you will be liable should you return the car early etc ?

    Yes,only if if the lad who hit me from behinds insurance company refuse to pay the car hire as I sent it back early, but as I said in my last post I am saving his company money why would they suddenly not pay them when he is at fault, :)

    I'm surprised the contract specifically states you are liable if you hand the vehicle back early, does it simply state you are liable under any circumstances if the other party don't pay

    I am under the impression from them that his insurance do pay for the car when a non fault claim which it is, he drove into back of me and drove off. Only when I said I wanted the car sending back this is when drive assist said that his insurers may refuse to pay for the car in the claim as I had sent it back early, this is what has confused me somewhat as why would his insurers not pay for the car just because it went back before mine was repaired, sorry to be dim, :):rotfl:To add yes if his insurers dont accept that the accident was his fault as it is hire agreement then I am liable for the charges, that is why they ask for credit card details I assume.
