I live in Scotland and the parking charge was issued for parking in Glasgow King Street.
Have you any idea how valuable that statement is? Provided you don't give them information as to who the driver was they have no prospect of relieving you of your cash.
if I don't then they will send debt collectors to my door and if I still refuse to pay then I will be taken to county court.
Provide a copy of the letter that says precisely all of the above and I'll pay this for you! Which 'county court' are you imagining will be the relevant one in Scotland?
I'm now worrying about debt collectors
If you're going to quake at debt collector letters, then best you pay this. If you are capable of reading them, laughing at them, then filing safely away, then you'll be paying nothing.

Scotland is bombproof provided the identification of the driver is not given to the PPC.

    Just ignore this!

Post a new thread if you don't believe me!
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

On page one, the 'new thread button':

    http://forums.moneysavingexpert.com/forumdisplay.php?f=163

And no, it does NOT say this!
if I don't then they will send debt collectors to my door
Why oh why do people think 'debt recovery' is people coming knocking?! The letter DOES NOT say that! Debt recovery is guess what? DAFT LETTERS!

But your case is the same as mad-designer's thread, so no need to start another one. Relax.

  • I have recently received three of these notices from TRACE. I had appealed them originally via NCP but clearly to no avail.

I just wanted to add to this thread by saying that my notice has an additonal 'threat' in relation to being in Scotland. Does the advice above still stand?

    Here is the text:

Your case has been passed to TRACE Debt Recovery Limited for the collection of an outstanding debt. Our client NCP has written to you requesting payment for parking charges relating to the above PCN, however to date the debt has not been settled.

Additional charges have been levied to cover the cost of recovery. Since a Supreme Court ruling in 2015 (applicable in Scotland), private parking companies have been pursuing unpaid PCN through Scottish courts with high success rates.'

I havent admitted driving the vehicle as per the previous posts. My concern i suppose is having 3 of these could mean that they could be more motivated to pursue it further.

Any advice would be greatly appreciated.

TRACE Debt Recovery Limited are no different than any other debt collector - ignore them.

What they say is not true at all (we know because the BMPA check daily court listings and have done for a few years):

    https://bmpa.zendesk.com/hc/en-us/categories/200603822-Scotland

Only a couple of firms have even tried a claim in Scotland and NCP are not one of them. NCP do not even know how to litigate in England!

The one case is not in Scotland and must be a very rare situation. I think it might have been connected to an NCP contract or employee - not a motorist - if it's the one I'm thinking about. And NCP may well have lost it, like they did the only other one we ever knew about:

HTH, relax. They are lying to you. NEVER ring these firms.

Odd thing to say, maybe there is somewhere else called Scotland they are talking about ...... not the Scotland that is attached to England

Beavis case, nothing to do with it
