Yes, because they wouldn't have regarded numbness, pins and needles or the occasional dizzy spell as being sufficient to exclude you from having to work. There are plenty of people working, ill or disabled or both, who have worse conditions that you describe but just take whatever medication they are prescribed to help manage the symptoms and carry on working. And because such people exist, and in large numbers, it makes it harder these days for anyone who would rather not work to get financial assistance to that end.
I'm not sure that the WRAG is fit for purpose. The government are already saying this group won't get any extra money over and above the dole from April 2017 (they say new claimants but it's a short space of time before they'll roll it out to everyone in that group on the grounds of "fairness" to those who don't get the additional money because they are new claimants).
Good, it'll stop all those fake 'bad back' claims if they're not going to get any more money.0 -
But if you can do all that, in spite of the pain and depression, surely it's not much of a leap to realise the DWP are going to expect you to work and not stay on ESA?
It's much harder to qualify for ESA these days than it was even three years ago. The benefit might be called the same, but the goal posts have definitely changed.
The point is I could not do it ,and the Job coach saw that . She advised me ,as I was appealing , to take the thirteen weeks sick allowance. By the end of which the appeal had been accepted , and I was able to go back onto ESA at assessment rate . So believe it or not there are actually people at Job Centres that have a soul , unlike yourself , a judgemental thoughtless tw-t !0 -
They kicked my oh of ESA support group and said he was fit for work he is in a wheelchair and cant self propel , they advised him to claim JSA but when went to sign on they wouldn't let him as they said he clearly was not fit to work and told him to appeal. So he cant claim ESA and cant claim JSA his crime to be is disabled apparently it gives all the smug people the right to treat them like lepers spongers and fake .
Yes he gave up a job he spent 6 years training to do, a career he worked 7 days a week in all weathers to achieve to give up earing 6 hundred pounds a week to ponce of the state to have to preform tricks at medicals have most people look down their noses at you all for £ 146.00 per week really don't know why more people are not doing it .i cant slow down i wont be waiting for you i cant stop now because im dancing0 -

I'm not going to read all this as it is too much a pain in the butt to read the wide posts due to link too long.
What I will say, is that this ESA claim is now closed so you can't ask for a supersession. You can make a new claim to ESA with evidence of a worsening condition.
But you would be more sensible to NOT make a new ESA claim, but to appeal the Man Recon, obtain a Med3 (sicknote) from your doctor, close JSA and go back onto ESA "on appeal payments".
You should also be aware of the ESA descriptors, having a diagnosis of an MRI scan isn't going to cut you any slack, what you need is evidence of how your condition fits the descriptors. and if you don't fit enough descriptors, then evidence of how your health or someone elses health would be at risk if you have to continue claiming JSA and look for work.
Oh and it's never too late to send DWP ESA new evidence, any new evidence you send in will be looked at by the Man Recon Team, especially if you mark it "for attention of ESA Mandatory Reconsideration decision dated xx/xx/xxxx" the date of your original decision, although putting the Man Recon date would also be ok.0 -
UPDATE . In paperwork sent by DWP ahead of Tribunal , they included part of previous assessment . It did not include points award or explanation of decision to put me in WRAG . After requesting this via the Clark of court , ha ho it arrived 6 days before the hearing !
Well surprise surprise , I was awarded no points previously ! But was placed into WRAG on exceptional circumstances . This changes everything . I have been attacking from the wrong angle .Thinking I had failed on the points. I tried challenging the assessment process. I am now preparing for the Tribunal on the basis that the exceptional circumstances still apply.It only leaves a short time to get everything together so I may ask for an adjournment at the Tribunal .0
