Hi, sorry for the confusion, yes I did copy and paste anything i felt migt be relevant and anyone who was in the same boat.
Guys dad can you explain the hashtag 28 -sorry can't find the symbol. I have seen a few people say things like this but i don't know how to find it.
Thanks Guys.
Had another letter today from MET it reads like this:
PARKING CHARGE AMOUNT DUE £100.00
THIS CHARGE IS NOW DUE
Dear
If full payment of this charge has not been made within 7days of this notice being issued further action may be taken, such as instruction of solicitors/debt recovery agents to secure immediate payment or the issuing of court proceedings which could incur further costs. to avoid further unneccesary costs and action, please pay the outstanding parking charge amount as stated above, in accordance with the parking terms and conditions.
further information including how to pay, the right to appeal (PLEASE BE ADVISED THAT THE INDEPENDANT APPEALS SERVICE (POPLA) IS NO LONGER AVAILABLE)?????????????????,etc can be found on the reverse of the notice
Any comments of the above about POPLA?
Should they be contacting me, I only received my POPLA code on 11th Nov?
Thanks in advance everyone0 -
Each post in the thread is numbered (see at the right hand side of each post).
#28 is the 28th post in the thread.
Looks like they are trying to say your POPLA appeal code timed out???? What was the date on the appeal rejection?0 -
Thank you I will try to find it0
-
if you look at your last post , it was post number 44 , so hash 44 or #44
so very simple and straightforward
if you have a popla code then use it , ignore what MET have sent you as its probably a roboletter
concentrate on your popla appeal only , nothing else (apart from any landholder complaint as well)
if your popla appeal has been submitted , complain to the BPA about this last letter and enclose a copy , plus give the BPA your popla reference as proof that the claim should be on hold and MET have failed the BPA CoP0 -
Did you mean the 28 post in my thread as below, sorry just getting a bit confused which is very easily these days.
Thank you
Dear MET,
I received a Notice to Hirer from you at the end of September. As your records will show, I appealed in good time, declining your invitation to name the driver and pointing out that I cannot be held liable because you failed to follow the POFA 2012, Schedule 4.
I also noted and was saving for POPLA stage, the fact that the alleged 'overstay' beyond the alleged 60 minutes free parking, appeared to be a mere 12 minutes. I am aware that the BPA Code of Practice prohibits such a charge because there are two Grace Periods set out. A driver MUST be given a reasonable time on arrival to read the signs and decide whether to stay and accept the 60 minutes free parking offered. It is not unreasonable to consider that this first period of grace should, of course, allow a few minutes because to arrive, find a space, park, alight, lock the car then read the signs cannot possibly be achieved simultaneously with the time that the car is caught by ANPR cameras at the entrance. Nor can any 'period of parking' be counted from that moment. Then you MUST allow the second mandatory Grace Period set out in the Code, which specifies a bare minimum requirement for leaving a car park after expiry of parking time, as at least ten minutes. Not a maximum, this is a minimum.
I plan to state the above - and the fact that I cannot be held liable as hirer due to MET's failure to follow Schedule 4 - in my POPLA appeal but you appear to have overlooked my POPLA code. I assume this was an error on your part because a keeper/hirer is entitled to appeal to POPLA as long as they appealed in time following receipt of the NTK (or NTH in this case).
Should MET withhold my POPLA code yet continue to process my data, despite you being aware that you are unable to hold me liable for this charge, I will be reporting you to the Information Commissioner for your Data Protection breach.
For the avoidance of doubt, I do not consent to MET processing my data and (unless you send me a POPLA code as you were required under your ATA Code of Practice to do) you have no reasonable cause to continue to store and use (and certainly not share) my data. You have exhausted your enquiries as regards inviting me to name the driver, which was the only reason the DVLA supplied my name and address and the only excuse you had to write to me at all.
As such, your only remaining options were (and are) to offer me a POPLA code or cancel the charge. If I do not receive my POPLA code by return, within seven days, I will as a first step, report MET to the BPA and also by direct email to Mr Dunford at the DVLA.0 -
posts #37 and #38 stated you now had a popla code and you are working on that popla appeal
you had 28 days to submit your popla appeal so should be working on it for the last 2 weeks and probably need to submit it within the next 2 weeks , so dont miss the popla deadline
this current letter is probably a follow up letter chasing the alleged debt , so ignore it and get working on that popla appeal
forget your last post as that was what was required to get a popla code, once you had a code for popla you forget about MET and concentrate on a popla appeal, which we have not seen you publish yet0 -
Hi just had a look through my posts,
29-sept orignal notice
7-oct i sent of appeal
21-oct had refused appeal letter BUT NO POPLA CODE
4-nov I sent letter asking for POPLA code
9-nov received a replying saying we don't reply to emails
11-nov I emailed again saying I had not received my POPLA code
14 - nov MET finally gave me my POPLA code
So shouldn't it be from the 14 nov that I start my 28 days?
I have done anything yet trying to get it all together and get it checked by all you wonderful people first, is that right?
thank you0 -
in theory yes , you are correct, although MET may have been sneaky and backdated the code a day or two or a few
you are best to assume that the popla appeal needs to be submitted within the next 10 days or so, to be on the safe side
so you should be drafting it over the last 10 days and over the next 10 days too0 -

Email the BPA to complain immediately:
aos@britishparking.co.uk
So is your POPLA code one with the numbers 2..6 in the middle or 3..6?
And a plea to other posters: no-one has to refer to any POPLA code checker to suss the date of issue of a POPLA code.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
