Yes, that makes perfect sense - MET's failure to provide you with a copy of the original Notice to Keeper (i.e. the notice sent to the hire company) is one of the many reasons why they didn't comply with POFA 2012.0

It makes sense but you only need to use 4 or 5 pre-written POPLA appeal templates you will have found in POPLA Decisions (September posts by me and Edna Basher).Can i just ask
The car hire firm sent us the ntk that they had received of MET, but MET only sent us a letter, not the one with the pictures of the car. So will this help us because they didnot send it and how would they know we had even seen this ntk unless the hire company said they would send it to us otherwise we have only had a bog standard letter without the photo's, if that makes any sense.

Thanks again coupon mad, just looked all it says is youve reached the end of inter appeals procedure. you now have a number of options
1. pay or, if your not the driver of the vehicle at the time of the incident, request the driver to pay the Parking charge notice at the prevailing price of £50 within 14 days of todays date. and then after this £100
2. if you choose to do nothing, we will seek to recover the monies owed to us via our debt recovery procedures and may proceed with court action
and then its signed but nowhere can I see POPLA Code ??0 -
also, i have posted exactly what the letter said but no where does it state our reasons- being hirer and them not sending the proper letters out etc but for a different reason.0

Dear MET,
I received a Notice to Hirer from you at the end of September. As your records will show, I appealed in good time, declining your invitation to name the driver and pointing out that I cannot be held liable because you failed to follow the POFA 2012, Schedule 4.
I also noted and was saving for POPLA stage, the fact that the alleged 'overstay' beyond the alleged 60 minutes free parking, appeared to be a mere 12 minutes. I am aware that the BPA Code of Practice prohibits such a charge because there are two Grace Periods set out. A driver MUST be given a reasonable time on arrival to read the signs and decide whether to stay and accept the 60 minutes free parking offered. It is not unreasonable to consider that this first period of grace should, of course, allow a few minutes because to arrive, find a space, park, alight, lock the car then read the signs cannot possibly be achieved simultaneously with the time that the car is caught by ANPR cameras at the entrance. Nor can any 'period of parking' be counted from that moment. Then you MUST allow the second mandatory Grace Period set out in the Code, which specifies a bare minimum requirement for leaving a car park after expiry of parking time, as at least ten minutes. Not a maximum, this is a minimum.
I plan to state the above - and the fact that I cannot be held liable as hirer due to MET's failure to follow Schedule 4 - in my POPLA appeal but you appear to have overlooked my POPLA code. I assume this was an error on your part because a keeper/hirer is entitled to appeal to POPLA as long as they appealed in time following receipt of the NTK (or NTH in this case).
Should MET withhold my POPLA code yet continue to process my data, despite you being aware that you are unable to hold me liable for this charge, I will be reporting you to the Information Commissioner for your Data Protection breach.
For the avoidance of doubt, I do not consent to MET processing my data and (unless you send me a POPLA code as you were required under your ATA Code of Practice to do) you have no reasonable cause to continue to store and use (and certainly not share) my data. You have exhausted your enquiries as regards inviting me to name the driver, which was the only reason the DVLA supplied my name and address and the only excuse you had to write to me at all.
As such, your only remaining options were (and are) to offer me a POPLA code or cancel the charge. If I do not receive my POPLA code by return, within seven days, I will as a first step, report MET to the BPA and also by direct email to Mr Dunford at the DVLA.

You have gone above and beyond for me, i look through but after a couple of hours i need to rest (do to my condition- not laziness) and my mind gets all foggy and then when i go to look again I cant remember what i was searching for and do it all over again. I cant tell you how grateful I am for that. xxx

Well as in the letter I had asked for my popla code within 7 days but they still did not give me a popla code.
So, do I just sit and wait for the 7 days to pass if so what do I do after that because as far as I can gather I cannot go to popla without a code.
Any help from you great people who be much appreciated.

correct, wait for the popla code and if it doesnt arrive then report them as advised above by CM
nobody can appeal to popla without a valid popla code0
