Card used without permission - Asking bank to get money back from council.

  • Allowing someone else to to use your card will be against the t&c's and as such the bank will probably tell you to foxtrot oscar.
As allowing a third party to use a bank card may be in breach of the terms and conditions of that card, it's possible that the bank won't only refuse to attempt to recover the money, they may even consider cancelling the card totally.

Personally, for the sake of £3 I would suggest that you forget about contacting your bank and instead see if you can get the money from your relative.
The chances are that nothing will happen but for such a small sum, is it really worth the risk?

I think post #2 was a bit out of order.

"But I'd say the effort required to retrieve £3 is going to be disproportionate; my guess is the bank will be unable to help and the only option would be the courts.
    "

"Admittedly the post wasn't all cuddles and fluffy stuff but perhaps due to stressing about money, you're perhaps a little more defensive than normal? Just a thought. "

I admit maybe the response was a bit OTT. £3 maybe seem like a small amount, but as I said, I am struggling financially and £3 can easily get me dinner for 2 days (canned food, pasta, etc.), milk, etc.

The Bank won't be refunding any money, nor will the Council.

Basically, your family member owes you the £18 difference between the £30 she gave you and the total of £48 she paid elsewhere with your card.

Were the payments made with your PIN number? If so, you must take full responsibility for allowing this regardless of how much was spent over and above what you agreed. It would be the same if money had been similarly taken via a cash machine..
  • Oh dear! BoP now interrupts for the hard of reading.

OP allowed someone to use their card of bank to pay the rent. Unfortunately the ex friend, was a family member until recently, of OP, was not too truthful over the amount owed and paid a lot more than requested.

OP wants their money back. Unfortunately, it looks unlikely ex friend has such funds available.

Morale. Next time do not give them your card, but if you wish, give them cash. Better still, frog march ex friend to payment desk, and pay yourself. Then wave goodbye to said money, and tell ex friend, that you did them a favour, but only this time. Next time budget better.
  • Nope, it wasn't done with my PIN.

I believe I covered this in a previous post. I accept the original payment would not be reclaimable, but want to know if the £3 payment is as it was done without my awareness or permission.

Basically, you want a refund from the Bank for something which you allowed to happen yourself by giving your relative possession of your card?

If you want a refund then you'll have to report your relative to the police for theft and state that she had your card without permission.

Do you truly believe the Bank will otherwise give you back your £3? Your relative owes you the money, no one else.

I'm beginning to doubt this thread is genuine.

Tbh I thought you were annoyed at the £18 over what she said it would be rather than just the £3.

Or at least if ive understood your post, your family member told you £20-30 before using the card, gave you £30, told you £45 had been taken after they'd used the card yet it was actually £48.

Have you determined what the additional £3 payment was for? Was it put through at the same time (e.g. it could be a fee for paying in instalments) or a day later (e.g. she kept your card details and used them again)?

I'm thinking that if it was a fee, then the family member might not have realised she'd be charged at the time of asking for a loan ...

I've noted on another thread today it feels like it must be a full moon tonight. Think I've already overstepped the mark once today so maybe time to step away from the keyboard :rotfl:
