Petrol - no means to pay declaration?

    Pay on your credit card, submit an expenses claim straight away, hopefully the money will hit your account before you even get your credit card bill.

    I didn't just ask if the staff remembered every customer.
    I asked if they remembered every customer and the method of payment they used.
    Just because someone always uses the same way to pay for goods, I wouldn't expect the staff to remember it after all, they are probably dealing with many hundreds of different people during their time at work.

    And as already said... The member of staff DID remember op and her method of payment!

    No, op made a statement about her finances in a rant about poor service! She didn't ask for financial assistance or a review of what her finances should or shouldn't allow.
    So how op would be able to afford other things as they cropped up such as 'boilers' etc is of absolutely none of your business. It's of no more relevance how she's pay for her boiler repair as it is whether she's seeking promotion or better paid employment.

    In which case they should have had notices up about changes to their business. It's poor service through and through and why you lot are giving op a hard time beyond me. Whether people like it or not £50 is a significant sum of money to some people including op!

    Anyone had experience of the declaration?? I am really worried as it says they will call the Police if I don't pay it within 7 days? I physically don't have the money to pay it!!
    Don't worry about the police. You'd only have committed theft if you took the fuel with a dishonest intention of avoiding paying for it - which is clearly not the case. At most they might contact you and ask you to explain what happened - but collecting civil debts for private companies is not part of their job description and they'd drop it as soon as it was obvious to them that no crime has been committed.

    Seven days was given to pay for the fuel. If the OP pays for the fuel within that period, then you're right - there clearly was no intent to take the fuel without paying.

    But if that period expires with no further contact, and no attempt to pay... then it becomes MUCH less clear-cut.

    Let's say that the fuel card hadn't been removed from the acceptable forms of payment - but was declined for some reason at the till. Perhaps the card had been damaged and become unreadable. Perhaps the issued declined to accept it. What then? The OP would still be in the same position - unable to pay for the fuel they'd taken.

    I'm pretty sure you have 28 days to pay a fixed penalty - If your bolier packs up you can have invigorating cold showers until you can afford to have it fixed. If your washing machine catches fire and burns your house down then having 50 quid will not help much!

    No it doesn't. The crucial question in cases f theft or other crimes of dishonesty is the OP's intention at the time of the incident. If he made an honest attempt to pay then clearly there was no intention to steal petrol on his part, so no offence. It does not and cannot retrospectively become theft because he takes longer than the retailer would like for him to settle his bill, or even if he never pays up at all. Any more than you can be arrested for stealing gas because you're late paying your gas bill.

    See the CPS guidance on this type of case here, and in particular the section on single incidents (tl;dr - they will only be prosecuted in the most clear cut cases of dishonesty).
