I did actually read it literally at first, assuming that OP had a neighbor who thought a "witch" was below her. I was half suspecting a reel of paranormal ghost pictures on here!

But to refer to a living human being as a "witch" is somewhat reflective on the individual, if not entirely conclusive of the whole situation.

A few thoughts.

The covenant is most likely between the householder and the developer. These are put in place by developers to prevent nuisance neighbours causing problems while they are still selling properties. Once all the properties no the estate are sold, the developer moves on, and couldn't care less whether or not somebody breaks them.

There's no point in sending a Letter Before Action to somebody unless you know what the action is going to be.

Filming somebody in their own garden is certainly likely to be considered harassment. Just saying "the council told me to do it" isn't going to be a very good defence.

If you're going to take on a lawyer, you really need somebody who is clued up on the law to advise you.

If youd wanted to gain footage, it would also have been so easy to covertly film them .
One wonders why, if you've had three years if problems, and you say she has legal training, you'd blatantly stand there in full view(at night?) and film them? Anyone would be freaked out.

thansk for the positives people. Honestly. this is just one of many issues the estate have had to deal with. Just unfortunately, this one neighbour is getting worse than what others have had. Many incidents have happened to others but we can not prove it, but there is the same pattern. She is known as the witch as she has grown her hedge to ridiculous heights and it's the kids named her the witch, so there is justification to that name. Like i said, she is a lawyer by trade so will be very clever in manipulating the law. Saying that, she had another small get together lastnight in her garden so, the good neighbour stayed at a friends house just so she could get sleep.
The board is working on her but everything ends up with court action. she has had warnings previously but her attitude is stick her fingers up the everyone else.

Why on earth would you think that? Just by calling a neighbour a witch doesn't mean the OP is in the wrong which is presumably what you are inferring. You wouldn't expect them to refer to the neighbour as a poppet would you?

My late mum lived next to a complete (text removed by MSE Forum Team). She used to do B&B for uni students and one of his little 'tricks' was to go round spreading the word she was running a brothel. A solicitor's letter shut him up.

If your friend calls environmental health every time the downstairs has a noisy party til 4am.., the neighbour is going to get the message eventually. Either that or Environmental Health will be removing her music equipment frequently. This will only work with noise though, not smoke.

Your friend will just have to keep the relevant windows closed if smoke is a problem.

Growing tall hedges does NOT make someone a witch. That generally takes some skills and beliefs. I gather your friend feels its ok to copy these children and their ridiculous name calling? Not sure what that says about her.

If you'd have turned round and said "she follows Witchcraft, is a Wiccan or follows Paganism" then fair enough; for the purpose of this thread (I don't want a debate on the differences!) then she is a witch

So in one fell swoop you've insulted both the woman in question AND those who follow one of the above traditions/practices.

And then you ask us for advice?

I too don't approve of name calling, or put downs, as said, both a form of

Who knows who's to blame?

My working life has been involved dealing with very bad people, I also know that what people present as "Truth" may be varying degrees of that. Can't see why you think I don't know anti social behaviour exists?

I'd expect the op to have posted initially about ear splitting music, shouting , banging etc,but it's hardly been mentioned.posts started with a list of petty misdemeanours- deliberately starting bonfires ' to annoy them' , chimenea too near the window stopping them sleeping ( as said, close windows) , and now she's grown her hedge too high.

I couldn't help thinking that the reason environmental health/ police aren't really mentioned is that the noise level doesn't interest them.particularly after three years.

It's more likely mediation is needed.

I've worked for many years in mental health and some of my clients suffered/experienced mental breakdowns and part of my job speck was to assist in them recovering which was a very long process in some cases.

So you don't think a lawyer deliberately harassing someone to the point that they are becoming emotionally fragile with the possibility they might crack isn't a form of bulling?

I have tried to be as brief as possible to keep it short and sweet. As the answers have gone off tangent, then we all get lost. The person in questions has lots of different names by other neighbours but used just one. She knows how to wind up people and has committed criminal acts herself but unfortunately, cannot be proved. It is intentional intimidation that she does and knows what others feel about it. Back to the originl question if possible, is it illegal or legal to take photographic evidence for evidence to make a case against a neighbour from hell. It has made life hell for the neighbour who is at the end of the harassment from theneighbour from hell.
I could write another thousand words on other acts that have been carried out by the neighbour from hell but trying to keep short for the benefits of those who make valid contributions. Now if i was the nighbour above, i could easily carry out revenge attacks and make her life hell to but i was brought up and not dragged up. Plus, i could get into more trouble as being the victim initially by defending my castle.
