Husband refused PIP so scared about what we are going to do

    The above two points would say to the benefits people that this person doesnt need that much help IMO

    although you don't need to be receiving the help in order to claim PIP, you can't say someone is actually helping you ( not that you need help) if if they're not.

    you have to prove the need and not help you receive to meet that need.

    it does seem that there may be an issue with how permeant they see the needs

    I would defo speak to the CAB or something similar re filling in the forms for ESA and they should be able to help with appealing the PIP decision.

    I lay his tablets out for him before going to work I then ring him several times during the day to tell him when to take the Meds or do his peak flow measurements otherwise they will just sit there and he won't registered that he needs to have them.

    I use my holiday at work and make up the time to attend his appointments where I can if not his therapists ring me to arrange his next appointment I then keep track of them and tell him where he needs to be and when. You can tell him something 2 minutes later he has forgotten

    I say at the moment as we hope once they have confirmed the nature of his brain injury it still under investigation and with the aid of therapy it will improve it may never be what it was but we are hoping for improvement of some kind we are trying to be hopeful

    Trust me I wish the bloody insurance would bloody well pay out its been 6 months we haven't had a penny out of them and it's now going to court and we are waiting for a hearing. It is out of our hands it was a total none fault claim and the other driver has accepted liability

    Managing medication is 1 point only.
    So you will need to identify another activity / descriptor.
    How about - Needs prompting or assistance to be able to make complex budgeting decisions. 2 points.?

    We did say about his budgeting but because he could take £7 away from £100 and the another £7 again this in their opinion meant he was ok. Not the fact that if he sees say £50 in his account he can't remember he has a DD coming out in 2 days for £30 etc.

    He scored 2 pts for preparing food (needs an aid to prepare), 2 for washing and bathing (needs an aid ie me), 2 for dressing and undressing (needs an aid again me). Then on mobility 4 pts for moving more than 50m but no more than 200

    He seems to have scored on the physically side of his injury but the mental side seems to have been ignored. He is having level 3 CBT, speech therapy and occupational therapy.

    He is also under Neurophyschology and a neurologist both have raised concerns with his cognitive recall, memory, attention and concentration. The neurologist believes there are significant ongoing psychology and psychiatric issues that need further exploration

    The 2 points for complex budgeting looks at ability to manage household financials, pay bills, and plan future purchases etc.

    This is what the PIP assessment guide says:
    "This descriptor applies to people who need assistance with
    managing their household bills or planning future purchases. A level
    of vulnerability due to a cognitive or developmental impairment
    which leaves the person vulnerable as a result of not understanding
    everyday financial matters should also be considered.
    This activity also applies to people who need prompting, e.g. those
    who need to be encouraged or reminded to make complex
    budgeting decisions.
    Where bad budgeting decisions are made, consideration must be
    given to whether this is as a result of a health condition or
    impairment.
    Similarly, some individuals may lack motivation to carry out this
    activity and consideration must be given to whether this is as a
    result of a health condition or impairment and whether the individual
    would carry out the activity if they really had to, for example if they
    were to receive a final notice to pay a bill."


    Would DL activity 9 be relevant (due to concerns with his cognitive recall, memory, attention and concentration.)?

    Activity 9 – Engaging with other people face to face
    This activity considers a claimant’s ability to engage with other people,
    which means to interact face-to-face in a contextually and socially
    appropriate manner, understand body language and establish relationships.

    "Needs prompting to be able to engage with other people.
    2 points.

    ‘Prompting’ means reminding, encouraging or explaining by another
    person. For example: may apply to people who need
    encouragement to engage with others in the presence of a third party."

    In fact with such a bad short term memory, you may well have a good agument for social support (4 points).

    This should have scored a point. Under PIP (unlike DLA) promting by telephone is included.

    Do you have any toilet aids? Rail to help get off / on toilet, raised toilet seat?

    With a poor short term memory might this apply - Activity 2 d. Needs prompting to be able to take nutrition. 4 points.?

    PIP assessment guide -
    "‘Prompting’ means reminding, encouraging or explaining by another
    person.
    May apply to claimants who need to be reminded to eat (for example,
    due to a cognitive impairment or severe depression), or who need
    prompting about portion size. Prompting regarding portion size should
    be directly linked to a diagnosed condition such as Prader Willi
    Syndrome or Anorexia. In cases where obesity is a factor through the
    claimant’s lifestyle choices then this descriptor would not apply."

    Do appeal this decision.
    It will go to tribunal (the DWP won't change their mind at MR stage), but the tribunal service are very thorough. They will certaintly consider carefully the cognitive activities glossed over at the assessment.

    The advice now guide is very good and takes you through the appeal process.
