Husband refused PIP so scared about what we are going to do

OH received his PIP letter today to say he doesn't qualify for PIP following a car accident

He is getting results from 2 MRI's tomorrow on his shoulder and spine we are going to ring them with the results and ask for a mandatory reconsideration does anyone know how long this takes?

I am so scared we desperately need this money as he hasn't worked since the accident (6 months yesterday) and we have no money left now and have borrowed from everyone we know. His SSP is due to run out in a couple of weeks

I just don't know what to do any more I am literally at the end of my rope

    They have scored him 0 in sections that he should have scored points on

    Yes it will be ongoing he has a torn rotator cuff in his shoulder, possible cartilage damage in the shoulder leaving him with 30% movement, he has a possible c-spine compression, anxiety, depression, an ongoing investigation into a brain injury, possible PTSD

    Yes we sent the private medical report the insurance company had done, his report from the fit to work scheme (government based) and letters from the 2 different consultants he is under

    Have you applied for ESA? That's an income replacement benefit and he can get it when SSP runs out, even if he's still employed, as long as he's paid enough NI contributions in the last two years.

    For PIP he needs to ask for a mandatory reconsideration asap. You need to look up the descriptors and explain which ones he meets and why. Others will be along soon with more detailed advice, I'm sure.

    Not yet we are waiting the letter from his soon to be ex employer to start applying

    for a mandatory reconsideration does anyone know how long this takes? for me will be 8 Months to get final court decision ( unbelievable or what)

    Would strongly recommend involving your local Citizens Advice Bureau will help you through the legal gobbledegook

    Just looked at letter in full we are off by 2 points!!

    They have marked him for 0 in managing your treatments despite us telling them on both the form and at the assessment that I have to manage his appointments and medication because his short term memory is affected at the moment

    You don't say if you are working and, if so, how many hours per week and how much you earn.
    If your husband was working full time before the accident it's likely he will be entitled to Contributions based ESA for 12 months. If not, entitlement to Income Based benefit will depend on your work situation.

    I work full time 9-5 5 days a week and I get about £20K a year

    In that case your husband won't qualify for income based ESA, but he should get contributions based (as long as he's paid enough NI contributions in the last two years) for a year if put in the Work Related Activity Group or for an unlimited time if he's put into the Support Group.

    A PIP reconsideration can take anything from a couple of weeks to a few months. Based on threads on here it's usually fairly quick. It's rare for a decision to change on MR though.
