I don't believe I disagreed with any posters on that thread. I said that proof of delivery wasn't proof of receivership. Then several posters posted afterwards that legally proof of delivery did count as proof of receivership. I think someone posted a link proving it.
I don't remember posting again to say they were wrong.

I think you're deliberately missing the point.
If the OP wanted to claim under the fan guard guarantee that getmein offer then they have to obey the terms of that guarantee. They unfortunately didn't so can't claim under fan guard.
The first line of their guarantee states "you will receive valid tickets for your event". So they breached that as the tickets were not transferable and therefore not valid.
So is it ok for them to breach the terms of their guarantee but hold the buyer to them?0 -

As they say if you don't think you've got valid tickets then contact getmein and they will resolve it. If you contact the venue then it invalidated the terms of their fan guard warranty.0 -
Thats the thing I dont understand, Ive been to several concerts in the last couple of years and in each instance it says on the tickets and on the Ticketmaster/Eventim websites that tickets cannot be sold on and in some cases says you must show the card you paid with on entry (although Ive never had to do this) and yet Get me In and Stubhub are filled with tickets for the same concerts.0

I'm currently reading this thread on a small screen phone so I may well have missed it if it's already been mentioned, but surely if the payment was made by either a debit or credit card then there may be a good possibility of convincing the card issuer to do a chargeback by telling them that the purchased tickets were not allowed to be resold.
I would have thought that this must at least be worth trying before considering legal action against the seller.0 -
As I mentioned before, studying of the T&C's was essential before offering the OP advice.0
