Maybe they bought 8 tickets because they had a group of people going and then 2 people dropped out so they sold those two tickets and still used the others.0 -
I'd perhaps take note that if the seller didn't have the right to sell the tickets, the sale was invalid as one of the requirements of a legally binding contract of sale is that you need to have the right to transfer ownership.
The seller didn't have that therefore is in breach of soga/cra (depending on whether the seller is a trader or not).You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0 -

The simple fact is if they supplied tickets that couldn't be used for purposes stated in the description then op is entitled to a refund.
No different to buy any other goods. If you buy a tv with free view built in and turns out the freeview doesn't work you reject the goods and get your money back
Are you suggesting the OP takes 'Get Me In' to court or the re seller of the tickets? In both circumstances I could not see any ruling other than "you (the op) purchased at your own risk"0 -

The tickets were not faulty, the op shot them self in the foot by calling the venue who cancelled them due to being re sold...I repeat buyer bought at own risk.0 -

Apart from that, the seller terms on Getmein clearly state:8 WARRANTIES & INDEMNITIES
8.1 Warranties. The Selling Member warrants to and for the benefit of GET ME IN!, the following:-
(A) All tickets listed by the Selling Member are:-
(i) either "on-hand" or already ordered and 100% guaranteed and available for immediate sale at the prices listed;
(ii) the property of the Selling Member or the Selling Member is authorised to sell such ticket (by law, contract or otherwise) and no third party rights (including any intellectual property rights) are infringed by the Selling Member in listing the ticket for sale via GET ME IN!;0 -
