Successful PIP appeal for mentally impaired friend - from 0 to 29 points !

Hi, I am a lawyer and I recently supported a male friend with some severe mental health impairments to appeal a ludicrous decision by ATOS/DWP to recently award him zero points following a face to face assessment.

In the event it was a piece of cake to appeal and make the DWP and ATOS look thoroughly stupid. That said, it would appear that few disabled people are adequately equipped to overturn the system ... and the DWP clearly take advantage of that fact.

I assisted on a pro bono basis. If any members want to learn how my friend achieved such a successful outcome I'd be gald to inform you and/or answer any queries.

    Lawyer, but not a solicitor. IMO solicitors are generally a waste of space. Prefer ACAS & barristers

    What is a "lawyer, but not a solicitor"?

    Many claimants successfully appeal incorrect decisions, but I'm sure we'd be happy to hear of your experience of the appeals process.

    If you falsely represent yourself as a qualified legal professional when you are not, that is not helpful.

    Feel free to describe your experience of the appeals process if you want to.

    That is a criminal offence.

    I will report my findings solely to the Benefits and Work website (an excellent site for work and benefits that chrges a nominal annual fee)who are to their credit virtually troll free.

    It is a shame that trolls like you still operate on this site with a clear intention to discredit and divert well meaning threads with your own agenda.

    I'm not trolling, I'm simply asking that you clarify your professional standing. If you hold yourself out to be a "lawyer" it is reasonable that you explain what you mean by that.

    It's a shame you choose to post on a fee paying forum instead, I wouldn't want to discourage you from reporting your experience if it helps others.

    Its not that we have more patience as we grow older, its just that we're too tired to care about all the pointless drama ;)

    don't pat yourself on the back too hard,

    i went from 0 > right into the WRAG group, and didn't know !!!!!! i was doing....

    (unqualified / unemployed (...from sickness))

    not much important making them look like fools ?, when you need money to live etc ?, no ?

    rather low on the priority list...

    I do not find your " cloak and dagger " approach as to how you helped your friend helpful at all. Why should people PM you ? As someone who suffers serious mental health issues, even Pm'ing a stranger can be stressful. Why not be kind and share your experience publically ?

    i am pretty sure the "secret" remedy to success is that >

    mental health is a very grey area and open to MUCH debate.

    that atos / whom it is now, is in ruin (cannot "grade" sick people properly) , and the DWP only have reference material from your esa50 (which mentally ill people can have GREAT difficulty in filling in) + what atos/ have sent them.

    > this leaves a MASSIVE differential potentially between, needs of claimant and anecdotes in claim.

    therefore, when you have the opportunity to see a doctor / barrister(?) (at tribunal)> you can set the record straight, and get awarded the points, that atos/ should have in the first place.

    this is why you see such dramatic increase.

    i.e. atos "deserves as much credit" as a helper, for the "miraculous" increase ...if you see what i am saying

    (obviously not for the !!!!!!!! on sick people bit...)

    imho.
