Hi all,

I just had a letter that arrived at my previous address sent by a neighbour, being that a court notice regarding a parking fee claiming I overstayed on a controlled ar park somewhat over the limit time

The Address was changed shortly after but the company, hasnt bothered to check DVLA for the keepers address and kept sending all the letters to the old address. So in effect I havent been notified or given a chance to pay at the reduced rate, as stated in the law.
Only a telephone service for payments, so I havent had the chance to talk things trough

Anything I can do to have this fee reduced?

Thanks

First - get yourself into the parking tickets subform and start by reading the Newbies Sticky carefully - that outlines your range of options.

Then have a look at the various threads discussing having this set aside, which will cost you but should allow you room to challenge this properly and most likely win. :)

    Hi all,

One of my old neighbours just found a letter for me and managed to pick it a post it to me before the new owner of the property.

I have found this is a court notice regarding a parking fee when I overstayed on a service area for more than 2 hours, last september the 9th.

The Address was changed with DVLA shortly after but the company, parking eye, hasnt bothered to check DVLA for the keepers address and kept sending all the letters to the old address.

I'm asked to pay the cour fee, legal representatives and the fine itself with no discount. Parking eye only offers a telephone service for payments.

Anything I can do to have this fee reduced?

    Thanks

Does the letter say you have a CCJ and they want you to pay (i.e. is the letter from ParkingEye saying they claimed and you lost)?

    Or,

Is this a new claim? Court paperwork from Northampton County Court Centre with an acknowledgement of service section, looks like this?

If so, what is the date on the front page of the court form?

Thank you all for your help.

Coupon-mad, this is the letter I've been sent. From being re-posted, I received it nearly two weeks later, so I have limited time to take action

You need to remove that NOW

Then repost it once you have removed your vehicle details, password and reference numbers.

PE are known to trawl this forum to try and glean identifying info/stuff to use against people challenging them!

you have removed the date so you need to answer this earlier question
If so, what is the date on the front page of the court form?
ideally you would need to acknowledge this online on the MCOL site asap , leave the defence box blank and gain an extra 14 days

post #1 court sub-section of the NEWBIES FAQ sticky thread tells you this, especially the link to the bargepole post

OK that's a new claim to be defended (with our help) so acknowledge it NOW, tonight, using the MCOL password there on the front page.

Leave the defence box blank then start looking at other defence threads.

What date was on the court papers? Do not wait though, ACKNOWLEDGE.

And tell us about the parking event, was the driver the same person as the registered keeper (don't tell us who that person/people is/are). You are saying an overstay is alleged. How many minutes and which car park?

    Thank you. I aknewledged this.
I dont know the exact details, since I havent received the original correspondence. Address on the V5 was updated withinh 2 weeks of moving, however they must have gotten the old details.

This happened on a motorway service area while I stopped to rest

Parking eye (and others) are only allowed to apply for your details ONCE from the DVLA , in the case of PE who usually use ANPR technology , they are obliged to send a NTK within 14 days , so contact the DVLA electronically , and immediately after the incident.
