OK so defence it is then!

Am I right in assuming I can just use whatever you wrote earlier removing/changing the references to the petrol station? I'm not really good with writing this sort of things as the last emails prove...

    Thanks

I understand this, what I am asking is whenever I need to add something else or format it in a certain way, etc.

    Thanks

I wrote it pretty much so you can use it as your defence at this stage so yes, just make the necessary changes and your wife can submit that online as her defence, on the MCOL page.

I've been changing some minor things.

The charging facilities are located inside the car park, albeit these are designated bays where parking is restricted as per signage and no parking contract should ever be enforceable!

Shall I edit that bit? Thanks

You could change and remove that bit, won't matter:
    2. The alleged 'overstay' or failure to pay any on-site tariff [STRIKE]or
indeed 'entering and leaving the car park'[/STRIKE] is denied and it is
denied that the driver agreed to any parking contract, nor could
they be held to be subject to one.

And change defense to defence (UK spelling)!

    Thank you.

There's a box asking if my partner wishes to do a counterclaim. What shall she put there?

No - but that's answered in Bargepole's summary of what to tick in the boxes, so don't go saying you contest jurisdiction or other wrong stuff. Read Bargepole's summary.

    Just an update...

My partner received posted confirmation from the court regarding the defense about a week ago. It mentioned PE had one month to escalate the issue.

In the meanwhile, PE has been quiet about all this. No reply was given to any of the previous e-mails and also nothing trough the post (We're hoping they are not using the old address!)
  • Hi all,

My partner received a court letter asking to complete a Small Claims Questionnaire (Form N180) within the next two weeks to be filed with the court office along withy copies served to all other parties (I'm guessing PE?)

Whats this for? It appears the court is giving the option to either mutually set charges with PE or go to a court hearing. Any advice on how to proceed?

    Thanks
