ParkingEye - PCN - Leeds - Morrisons

Hi all,

Today we got a letter from ParkingEye titled as 'Parking Charge Notice'. They want us to pay £85 in 28 days. (It is discounted to £50 for 14 days.)

My wife visited Merrion Centre, Leeds on 18 May and used car park of Morrisons in it. She paid £3 for 1.5 hours and placed ticket to car. After 1.5 hours, she went back to car park and paid £2 to get a new ticket and replaced ticket in the car. So she totally paid £5 for 2.5 hours. Unfortunately, we don't have tickets anymore because we didn't think, we will get a fake PCN and didn't keep them,

In the letter we get, there are photos of our car and it says our car stayed in car park 2 hours 35 minutes. There isn't any reference to tickets we get from machine or it doesn't say how many minutes we could stay in park.

I don't understand, how this make senses. This is a pay&display car park. We pay money and get ticket after we park our car. There isn't any reference to our registration number in anywhere in this process and there isn't any option to enter it. So how they can know we paid or we didn't pay only looking by cameras?

After reading threads in this forum, we wrote to Morrisons and Merrion Centre about this problem and asked them to contact ParkingEye and cancel this charge. We will also visit Morrisons tomorrow.

- Now, should I appeal to ParkingEye immediately or should I wait for news from Morrisons or Merrion Centre?
- If I need appeal, which template should I use? I checked some of them, but they usually refer to signage problems etc. But our case is different.

These are dates in letter:
- Date of Event: 18/05/2016
- Date Issued: 25/05/2016

I got letter 31/05/2016.

    You must have had to enter the VRN into the pay and display machine keypad when buying a ticket if this was ParkingEye because that's how their system 'works'. I guess whoever paid missed that fact and didn't put the VRN in? So ParkingEye looked for your VRN matched to a payment and believed you didn't pay.

    Contact the Merrion Centre on Facebook and Twitter which is more likely to cause them to act quickly because Social Media complaints embarrass retailers:

    You can email Morrisons head office who often cancel PE PCNs within a week:

    That email DOES work and does get a response. Include copies of receipts or bank statement.

    Also appeal online to ParkingEye at the same time, a challenge from the registered keeper. NOTHING should be by letter.

    Your case is not different. The registered keeper can use the template in blue writing from the NEWBIES thread on this forum, and just add a line (like it tells you to) if attaching a receipt or bank statement. Don't remove the signage part from the template, it is relevant in ALL cases, including yours, if the machine didn't make it clear that a VRN was an obligation that could result in a 'penalty' - so the signs DID fail, then!

    DO NOT add anything that says who was driving but you could add the approximate times that the occupants of the car (keep it vague) made those two payments and how much was paid by 'the occupants of the vehicle'.

    Do you think mentioning paid amounts invalidate 'failed signs' argument?

    I am not sure how I can write vaguely and formally that I paid for tickets two times. Can I write '£3 is paid by driver just after car parked first time and then £2 more is paid around 16.45. These payments cover 2.5 hours period.'

    No. Because the failure was in the signs/machine not communicating that the VRN was an absolute obligation and failure to put the number in, could cost £100.

    Yes if you change it to the past tense, as shown. You could add that if a VRN was meant to be typed in why did the machine take the money? Why was the signage not clearer about this obligation and why does the system allow this to occur?

    And include the Morrisons receipt or bank statement as an attachment on PE's online appeal page.

    Their website says answering appeal may take up to 14 days. Does it mean that I will need to pay full amount if all appeals fails?

    Yes but trust us, we do this all the time. DO NOT TRY TO PAY £60 NOW.

    Of course, I won't try to pay it after the posts I read in this forum. Also I think, I have a big advantage because of VRN obligation issue.

    Did you send the complaint to Morrisons CEO or did it go to pleb class which is their customer service. Even so, it is very ignorant of a company to ignore its customers especially as they know all about Parking Lie.

    And on the subject of a lie, the manager lied to you, of course Morrisons could get it cancelled if they hold customers with high respect, suggest in your case they do not give a monkeys about you and your friends buying power.

    Up to you, for me if a company I spend money with play at being idiots the CEO needs a blasting.

    You have the power of Facebook, Twitter and other social media to name and shame this branch. Tripadvisor is also a good way.

    I still believe that these big companies have no idea that the internet is far bigger than they ever will be.

    Blast the CEO about this and tell me how ignorant his customer service are. Morrisons need YOU ...... YOU do not need them
