Then if using the phone when speeding is careless or dangerous it's only one offence.

If the Polizei were sufficiently bothered, I think that would only take a minute or two.

Really, how could they do that?

Obtaining subscriber details and showing the number in use at the time would not be proof.

Plenty of cases where holding a phone to your ear has been deemed sufficient to be "using" it as far as the law is concerned - there is no need to look at any phone logs,

A picture (if clear enough) would be enough to charge , and probably convict - but if no issue is raised about the speeding it is unlikely to be looked at closely.

I think that the forces of evil - sorry good - can do a lot better than that.

Surveillance is pretty near absolute these days - but only the paranoid are sure of it. ;)

Maybe they can, but as its not proportional to the offence such evidence would be inadmissible. :D

I dread to think what insurance cost would be with 9 points anyway. pretty much would have got me off the road when I was younger. To use the phone while speeding when already on 6 pts you would have to be pretty stupid or young. When I was young I admit I had a "It'll never happen to me" attitude. Luckily mobile phones were the size of a brick and owned by very few people.
