Fixed Speed Camera - Speeding and mobile phone use?

Hi, I am posting this on behalf of a friend. She recently received a speeding letter for 40mph in a 30mph limit. I'm not sure of the exact details but they were asking for her driver information. In the photo they sent with the letter she can be seen using her mobile phone but this was not mentioned in the letter, only the speeding offence. I believe the camera that caught her was a fixed speed camera. She currently has 6 points on her licence. Does anyone know how likely it is that she's going to get a ban? She's already been on a driver awareness course before. She needs her licence for her job and is having a serious meltdown. My theory was that the letter was sent through an automated system and that the photo was not actually checked by a human so whether that will be done later I don't know. If anyone knows the system or any information that could help it'd be much appreciated.

    I hope she loses her licence: 6 points already, been on the awareness course and to top it off on her mobile phone!!

    As for needing it for her job, you don't do stupid things in the workplace that could lose your job and this is no different.

    If she was speeding whilst on her mobile then she deserves to be banned.

    The fact that she already has 6 points and AND been on a speed awareness course implies she is a danger to others on the road.

    It's a bit late to have a meltdown. The situation is entirely of her own making.

    I'm afraid, having been nearly run over by a driver using their mobile, i'm struggling to find any sympathy for her situation.
    The speeding, 40 in a 30 suggests she's an average speed driver, the one's that do 40mph everywhere in auto-pilot.

    Everybody now got their moral indignation out of their system? How about answering the OP's query?

    OP you are quite correct that the system is indeed so automated that a human being probably hasn't looked at the photo, so in all probability your friend will avoid prosecution for the mobile phone infraction. So 3pts and a £100 for the speed, taking her up to 9pts and just one misdemeanor away from a totting up ban.

    BTW Isn't about time this sub forum had a sticky or banner, like the debt forums, stating that the forum is for support and help and not for judgement?

    She wants to make sure she doesn't do anything to make the photos get looked at too closely.

    Take the 3 points without any fuss and she may get away with the phone use (although hopefully the lesson has been learnt).

    They could choose to prosecute for both.

    First time caught speeding I would help, but 6 points, speed awareness course - not learnt lesson and top it off with using the mobile phone not paying attention, screw the support and help, had enough chances, licence lost is next step.

    I suspect speeding and mobile 'phone use while driving are two of the biggest causes of accidents on our roads. I think criticism of that kind of driving is perfectly fair.
