    Imagine the sympathy dtm247's "friend" would get if she ran over a child outside a school she was speeding past while using her mobile.

    Even if the photo is admissible as the sole evidence, is it clear enough to prove that what she was holding was a mobile phone?

    If it was, it is not illegal to hold a mobile phone. There is no evidence that she was using it.

    I'm not saying that a conviction is impossible, but it's likely to be too difficult to bother.

    So there you go OP. Your friend will probably only get done for one offence, even though she was committing two at the time.
    She can also sleep comfortably in the knowledge that she didn't hurt any kitten brandishing nuns...
