I think it may be better if you stopped your CA claim, and then your son may be able to claim the Severe Disability Premium of c. £62 (It is the same amount as the CA your are currently receiving). This would be added to his ESa. Is he in the ESa Support Group? The SDP can be paid if he is receiving middle or high rate Care DLA.

This, I think, will then increase his Applicable Amount for the HB calculation. He would then be able to receive up to a maximum of £152 HB towards the rent - per Post 8.

Your local CAB could confirm this, or talk to a sensible person in the relevant council dept.

What your son does with the £62 is up to him. As your are caring for him, he could give this money to you. However, because he is getting the SDP, it means his HB applicable amount increases.

Do check that I am correct.

One point, worth noting. To continue to receive this he has to be in receipt of DLA or PIP (the qualifying benefit). When the time comes that DLA stops and he has to claim PIP - DO get help (the CAB) with the form.

I will try and find the legislation. When someone receives Carers Allowance for looking after the claimant they lose the Severe Disability Premium.

The Severe Disability Premium is the key that allows 1 bedroom rate to be paid rather than the shared room rate.

The Severe Disability Premium is part of the Applicable Amount used to calculate benefit entitlement.

The HB calculation is right the previous advice given was wrong as they didn't ask if you were getting Carers Allowance.
These are my own views and you should seek advice from your local Benefits Department or CAB.

Thank you for your help in this matter, my stomach is in knots!

Please can someone confirm how I can find out if he's received the severe disability allowance, where would this be mentioned? In his dla paperwork or ESA ( I can't find it on either)

it wouldn't be mentioned with DLA, but would be paid as part of his ESA.
how much ESA does he receive?

you posted this, which mentions the severe disability premium
