Best Way To Object A Planning Application? Hes At It AGAIN!! UPDATED 19/06

    A development of this nature would not IMO necessarily have to be advertised by Site Notice.

    There are several ways of publicising applications, this is only one of them. Usually it is only larger developments or those in a conservation area or to a listed building that have to be publicised by Press or Site Notices. Normally letters to neighbours will suffice.

    Providing immediate adjoining neighbours have been notified, the Council have acted correctly.

    If they DO put one up, it usually has to be up for three weeks at some point during the life of the application and have dates on for when objections must be received.

  • We have had in the past many property owners building other homes in there large gardens but there has now been a real clamp down and most are being declined permission. Reasons have been neighbours privacy/crowding that goes hand in hand with such developments.. loss of trees and no room to plant more were sited often plus the upheaval to neighbours.
    We have a very private garden and it was the main reason we purchased this property ..so I can imagine how you are feeling with such intrusion hanging over you. Good Luck in your fight. Mrs Happy

    I have woken up this morning and bitbrighter and more up for the initial fight!!

    soappie was a great help making me break it down and just worry about the first step, dont worry about apeals etc.... yet.

    well the neighbour called round earlier and spoke to mr divadee i wasnt around.

    He claims that when he submitted the application the planning officer told him he would have no problems and its a mere formality. Now i spoke to planning on monday for 50 mins, and the planning officer said more or less the opposite of what he claims was said.

    The planning officer that this has been handed to had only seen the plans on monday morning as she was on leave last week. She said i have looked at them and the plot seems to small for the proposed development. Now whos lying??? Its made me very confused.

    He did admit to mr divadee that a bungalow even a 1 bed would not fit on the site as the footprint is obviously bigger on a bungalow. He has no option but to apply for a house

    His plans are to build this new house, sell his existing property and move into the new one. He also admitted that he is up to his eyeballs in debt and he has put all his eggs in this one basket so to speak.

    He had his house on the market this summer and said to mr divadee that none of the offers he received were enough for him to be able to move. As he is in so much debt. One of his viewers was a very well seasoned developer who came and asked to buy a part of our garden (like the neighbour has been trying to do). We refused and he kept asking. When he finally got the message he said, well theres no point in me going any further with this house as without your land i would never get planning permission. Now this developer has done well over 200 developments!!! He should know should'nt he???

    We have about 13 objection letters that we know about. So it will probably go to a full planning committee. But I have gone from being really positive to feeling omg if planning said he should get it then he will probably get it :mad:




    Hope anyone can help!!! By the way I was thinking of buying the which guide to planning is it any good? The only copy I can get is a 2nd hand one from amazon, but want to know if its worth it.

    also a friend of mine had a planning application go through next door to her, with the conditions of obscured glass as soon as planning signed it off he changed the glass and the council did not want to know!! even though it was a condition of planning.

    I have said I would be extatic with nothing, a bungalow could be a comprimise but a house is a big no no!!

    Also who would want a house with 2 bedrooms with obscured glass and a landing window obscured. Also the top of the downstairs french doors (there are 3 sets) if someone was tall they would also be able to see over. So do they make those obscutred as well!!!

    And again my arguement is that windows can be opened so we still have no privacy.
  • Just a quick point, I have been involved in some heavy local planning objections (we lost by the way, it can be a bitter pill), and our district council will only count a petition as a single objection however many signatures you can get. It is better to have separate objections from as many people as you can motivate.
  • Also, if it's any consolation, a new house was built close to my old property (I had to sell, their kids were unbearably noisy) and they had to exclude so many windows because of neighbours objecting to being overlooked that their house is like a prison. They tried to sell it recently but nobody was interested in living in a dungeon. Tee hee.

    thanks missprint. we have that i know about approx 14 letters of objection plus the petition. when i spoke to the planning officer she said she had recieved 3 objections as well. there may well be others that i dont know about as well.

    I already knew that the petition would count as one, but the cllr did say that it would show the committee the depth of local feeling. I think we have approx 70 signatures now. which is not bad for a small devlopment like this!!


    I just hope we can win, i think the bloke next door is bluffing as hes a right geezer bloke. you know the type dont ya!!!!
