A couple under the old approachThe ASA noted the complainant had been informed they had won the competition....cancelled the competition ..... we considered consumers who had been informed they had won a prize would legitimately expect to receive it. We therefore concluded that the promotion was not administered fairly and caused unnecessary disappointment.
The promotion breached CAP Code (Edition 12) rules 3.1 (Misleading advertising), 8.1 and 8.2 (Sales promotions), 8.15.1 (Administration) and 8.27 (Prize promotions).
Action
The ad must not appear again in its current form. ....ensure promotions did not cause unnecessary disappointment in future.

Wow, this is absolutely outrageous! I've never heard such nonsense from a company in my life. She's saying in her reply that she asked you to respond the same day, yet they only asked you to respond by 18th April! And it sounds like she's actually accusing you of something fraudulent, with no evidence whatsoever. her tone is really unprofessional - signing off "sure you understand, Amy" is really pathetic. I would definitely not take this lying down, is there any phone numbers for either this company or the ASA as waiting for replies to emails is going to be frustrating and time consuming!

Even worse, she did actually reply the same day and they're saying they didn't receive it lol! Outrageous indeed! Makes me suspicious of them. Why try to get loads of entrants' details if they don't intend to appoint a winner... hmm.

Throwing something else out there. They seem to be a small boutique. They may actually just be peeved that the comp was posted on here so those that entered may not be usual clintele thus less chance for future sales. A Google search shows the comp posted here on page 2 of Google. In good conscience they should discard all information collected during the comp, emails etc. I didn't enter but I certainly wouldn't want them to retain my personal information when they should have explained there had been fraud and they were closing the competition, why on earth did they pick a winner and then retract it claiming fraud. I don't know if it's just me thinking this, but you wouldn't award a winner after going to the police and it's rare to get the police to see you the same day about bigger crimes than a competition "fraud". Something isn't right for sure, especially with the timeline of deciding "fraud" had occured.0

I think they're classing compers as cheats. I'd like to see the police taking that one seriously! All it would've taken was something added to their (dodgy) T&Cs saying local entrants or no compers. They seem to forget we spend money too lol. I saw a nice pair of shoes on their site but won't be putting money their way if they think we're cheating!

I haven't had any email replying to my email unfortunately Diane till this one nor with a contact telephone number. Our competition has had to close due to a terrible fraudulent campaign and the police are now involved. This is the reason I had to ask you to reply the same day when I emailed - Tuesday 12th April to which you didn't therefore making us assume this email address was yet another fraudulent email.
