Globber scooter 3 month warranty

My mum bought my 4 year old son a globber scooter from amazon in november as an early christmas present as he just started school. Yesterday on way home from school (10min journey) the brake snapped straight off. Feeling that amazon is a safe place to buy from and offer good customer service i told her to contact amazon and see what they could do. She recieved a reply from the seller that the scooter had exceeded its 3 month warranty. I have looked on the website and facebook page and i cannot see anywhere a mention of 3 month warranty. He is only 4 just turned 5 last week. I didnt expect to buy a £50 scooter than is only going to last 3 months. His school shoes last longer than this. They are offering a replacement part at £6.95.
I know i dont have much chance with this and just need to buy another brake but its going to be an expensive scooter if i have to keep replacing parts every few months.

Just feeling a bit disappointed.

    The company was registered 2006. Although they did change their name in 2009 and their registered office was changed in 2010. Directors named now are the same ones that were appointed back in 2006 and are named directors for several companies (didn't look further into them but seem to be other sports/scooter companies)

    Now technically you have no rights as your mum was the one who purchased it. But she should contact them and remind them that faults that occur within the first 6 months from purchase are assumed to be inherent and it is for the retailer to prove otherwise.

    You mum could also contact amazon and see if they will get involved - although I suspect they might do so if the seller isn't complying with the A to Z guarantee.

    The only thing I would add is the possibility the damage could (not saying it has!) have been caused by letting the scooter fall to the ground when dismounting. Tends to be the handlebars that bear the brunt of the impact and brakes tend to be near the end of handlebars.

    I have told my mum all this. She is going to contact Amazon for me. The brake i at t the back covering the back wheel. It's like a strip of metal that just broke in half. Thanks for the advice

    Well she has contacted globber directly who are looking into it and also amazon telling them what reply she received from the seller. Lets see what happens over the weekend. Neither of us can do much more now till we see what they come back with. I hope they respond otherwise there will be additional bad reviews appearing on amazon as i have read a few appeari since we bought the scooter saying the same thing. Typical that no bad reviews when she bought it.

    Yesterday the height adjuster button came off inside the stem of the handle bars and the spring has broken. The scooter is jinxed. So my mum sent a request to Amazon to asked for refund as we are sick of this scooter.

    She has had this reply

    Greenover Action Sports has closed your return request. The reason for the closure of your request is: Return period has expired

    > Seller comments: As with previous correspondence - item is well outside of warranty period as well as return period. The warranty period is 3 months from date of purchase. Returns period is within 30 days of purchase as per UK regulations.

    I cannot believe what a rubbish scooter this is. My son is only just 5 and uses it twice a day for total of 20 mins.
    I am disappointed Amazon and the seller greenover sports. I don't really know what else to do

    You could try appealing to amazon that the retailer is in breach of contract - UK legislation forms part of your contract with them by default and they are in breach of the consumer rights act.

    The consumer rights act states faults that appear within the first 6 months are assumed to be inherent. Further to this, placing a time limit on claims which seek to free the retailer from their legal obligations or using terms which limit or restrict a consumers statutory rights can amount to a criminal offence.

    If amazon aren't willing to help though, you'd be looking at sending a letter before action then starting proceedings if that fails.

    However bear in mind your mum needs to do this - usually unless they're aware at point of purchase that its a gift, statutory rights don't transfer and remain with the purchaser. In other words, you have no contractual or statutory rights, just your mum does.
