Thanks. Yes she is having the correspondence I just tell her what has been happening.
I have drafted this letter with her details which I have printed out for her to post. 07/04/2016
Dear Sir or Madam,
REFERENCE: Smethurst/Greenover Action Sports-Globber - 'My Free' 2-C Junior Scooter - Red.
Amazon Order ID *********
I have ordered the item, Globber - 'My Free' 2-C Junior Scooter - Red, on 02/10/2015 which I purchased from Greenover Action Sports via the Amazon website.
I paid 49.95GBP for this item.!
I have discovered that the item is not of satisfactory quality. The brake broke off on 20th March and the height adjuster broke on 2nd April
The Consumer Rights Act 2015 makes it an implied term of the contract I have with Greenover Sports that goods be as described, fit for purpose and of satisfactory quality.
As you are in breach of contract I am entitled to a replacement or repair at no cost to me for the reasons outlined above.
I also require you to confirm whether you will arrange for the Globber - 'My Free' 2-C Junior Scooter - Red. to be collected or will reimburse me for the cost of returning it.
I await confirmation that you will provide the remedy set out above within 14 days of the date of this letter.
Yours faithfully,
I am not sure how to contact Amazon about this. They have closed the claim. They don't appear to be interested in helping with this. Unless there is a way of contacting them separately.0 -
Hopefully unholyangels advice will gain you a resolution. We've had this scooter for 15 months for our 5 year old (a couple of friends have had them longer) and no issues, despite much abuse http://www.amazon.co.uk/JD-Bug-Original-Street-Scooter-Reflex/dp/B00L1FEYWS?ie=UTF8&psc=1&redirect=true&ref_=oh_aui_search_detailpage. The major bonus is the carrying strap for when they get bored and you get saddled with lugging it home.0

Amazon have pretty strict parameters when reviewing Claims, a lot of people incorrectly think that Amazon will honour your statutory rights if a seller on their platform is not complying.
This is not the case unfortunately, the Claim does provide you with some added protection but in terms of defective items, unless it's reported to the seller within 30 days Amazon will not get involved.
Amazon customer services will be able to report the seller internally but any action taken would be handled internally and you would likely never learn the outcome.
You can ask Amazon to appeal the Claim but this would generally only be successful if your appeal could show that you had contacted the seller within the initial 30 days.
It might be best contacting your bank and asking about a chargeback.0 -
I have appealed against Amazon's descison. See what happens now0

If a refund is what she gets it will be back as vouchers.0 -

Yes we would be happy with refund in vouchers but they don't appear to even want to do that. I would be happy with a replacement or repair but they are not even giving me any option.
But surely you can only get charge back if you have used a card.0 -
pity only help for first 30 days.
Greetings from Amazon.co.uk.
We can certainly understand your concerns about the A-to-z claim for order being closed.
However, as stated in our previous message, we determined that you are not eligible for an A-to-z Guarantee claim as you did not contact the seller to make return arrangements for the merchandise within 30 days of receipt.
We understand that you may not agree with this decision, but this claim will remain closed.
Thank you for your interest in Amazon.co.uk.

Looks like its going to have to be an LBA to the seller then! You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0
